Role OverviewThe Senior IP Enforcement & Litigation Specialist is the firm’s single point of authority for all contentious IP matters, including patent and trademark infringement, enforcement actions, oppositions, cancellations, appeals, and litigation coordination.
This is a senior, hands‑on role responsible for taking matters from infringement detection through enforcement and litigation resolution, while coordinating with external law firms for court proceedings. The role also supervises IP watch services and supports complex legal matters across the firm.
Primary Responsibilities1. Infringement Analysis & Strategic Advisory (Patents & Trademarks)
- Conduct patent infringement analysis, including claim‑to‑product mapping and technical comparison.
- Assess trademark infringement, counterfeiting, and unfair competition matters.
- Evaluate enforcement strength, risks, and commercial impact.
- Advise clients on cease & desist, settlement, litigation, or border enforcement strategies.
- Provide cost‑benefit and litigation risk assessments before escalation.
- Recommend alternative dispute resolution where appropriate.
2. Enforcement Actions & Dispute Resolution
- Draft and manage cease & desist letters, warning notices, and enforcement communications.
- Lead settlement negotiations, coexistence agreements, and licensing resolutions.
- Coordinate market investigations and evidence gathering.
- Manage customs recordation and border enforcement actions.
- Handle online and marketplace enforcement (counterfeiting, takedowns, misuse).
- Convert watch alerts and infringement findings into structured enforcement actions.
3. Contentious Case Management – Oppositions, Cancellations & Appeals
- Draft and manage trademark and patent oppositions across jurisdictions.
- Prepare counter statements, defenses, and evidence of use / prior rights.
- Handle non‑use cancellations, in validations, and patent revocation actions.
- Track and manage strict procedural deadlines (zero‑miss tolerance).
4. Litigation Coordination (Court & Authority Proceedings)
- Manage IP litigation files end‑to‑end (strategy, evidence, deadlines).
- Brief and instruct external litigation counsel on case background and objectives.
- Prepare litigation bundles, expert inputs, and witness documentation.
- Coordinate hearings (virtual/in‑person) and monitor proceedings.
- Manage litigation progression through first instance → appeal → cassation.
- Ensure accurate reporting to clients and management throughout proceedings.
5. Watch Services Supervision & Enforcement Integration
- Supervise the Watch Specialist for trademark and patent monitoring.
- Review and approve all watch reports before client delivery.
- Identify which watch hits require opposition, enforcement, or monitoring only.
- Convert watch alerts into opposition, cancellation, or enforcement actions.
- Develop and improve watch protocols, templates, and enforcement triggers.
- Expand watch services (marketplace, domain, online monitoring).
6. Complex Legal Support & Cross‑Functional Collaboration
- Support the Actions Coordinator on complex office actions requiring legal argument.
- Draft substantive refusals, examiner response strategies, and appeal arguments.
- Coordinate with Patent and Trademark Specialists on technical and legal overlap.
- During low litigation workload periods, provide quality review support for trademark matters as directed by management.
7. Knowledge Management & Internal Training
- Maintain a database of opposition, cancellation, enforcement, and litigation precedents.
- Track jurisdiction‑specific contentious procedure updates.
- Develop enforcement and litigation templates and best‑practice guides.
- Train watch, actions, and consultation teams on escalation triggers and enforcement readiness.
Education
- Law Degree (LLB or equivalent) – Mandatory
- IP specialization is strongly preferred
- LLM in IP Law or Patent/Trademark Agent certification is a plus
Experience
- 7–10+ years in IP litigation, infringement, and enforcement
- Proven experience with:
- Patent & trademark oppositions
- Infringement analysis
- Enforcement actions
- Litigation coordination
- Experience coordinating with external litigation counsel
- MENA/GCC experience strongly preferred
- Deep understanding of patent claims and infringement analysis
- Strong legal drafting and argumentation skills
- Strategic litigation and enforcement mindset
- Negotiation and settlement expertise
- Exceptional deadline and case management discipline
- Ability to operate independently with senior responsibility
- Clear client communication and commercial judgment
