DescriptionUnder the supervision of a Human Resources Specialist 2 (Labor Relations), the incumbent serves as a member of the Labor Relations Bureau, which is responsible for the administration of the Department's disciplinary, grievance and performance evaluation programs in accordance with the provisions of the various negotiating unit contracts and/or applicable laws, rules or regulations.
Essential FunctionsAdvising supervisors at all levels, both orally and in writing, in relation to counseling, discipline, grievance and performance evaluations procedures. Advising department on the appropriate means for dealing with operational and/or employee behavior problems. Interpreting the terms of the negotiated agreements, Department policies, attendance rules and Civil Service Law as they may apply to the situation. Advice may include recommendations for counseling or discipline, a referral to EHS or EAP, or other action as appropriate.
Performing fact-finding activities in relation to employee grievances and disciplinary cases, drafting disciplinary charges, conducting agency-level hearings, monitoring the timely processing of grievances, and preparing agency-level decisions.
Conducting investigations using interviewing and interrogation techniques. Preparing notices of discipline in accordance with the employee contracts.
Advocating cases as assigned, including serving as, or assisting LR staff serving as, the State’s advocate at CSEA 33.5 time and attendance umpire hearings, expedited arbitration process, and at Article 33 non-expedited disciplinary arbitrations.
Working constructively with managers and union officials in both informal problem resolution forums and in formal Labor/Management meetings. Attempting to resolve problems at the lowest possible level. Advising first step reviewers on the appropriate response to formal grievances. Conducting second step grievance meetings and writing decisions. Assisting OER in obtaining information as requested.
Interpreting negotiated agreements, applicable laws, rules and regulations, and Department policies. Making sound recommendations to managers and supervisors in relation to the above.
Reviewing appropriateness of unsatisfactory performance evaluations and answering questions across the program and union spectrum about the general evaluation process as well as individual evaluations. Working with supervisors preparing appropriate evaluations and with addressing employee rebuttals.
Collecting and analyzing information from managers that support referrals to Employee Health Services for fitness-for-duty examinations.
Assisting with special projects as assigned. Participating in the development and delivery of supervisory training as it relates to labor relations issues. Traveling as required (Limited). Performs other duties as assigned. Meeting the Department’s standards for time and attendance.
