Comptroller – Senior Counsel (ESA)
Apply to serve as Senior Counsel for the Education Savings Account (ESA) Program at the Texas Comptroller of Public Accounts.
OverviewThe ESA Program, established by the Texas Legislature in 2025, will allocate funds to eligible students starting in the 2026–27 school year for tuition, tutoring, and other approved educational expenses. The Comptroller’s office will oversee the program’s financial integrity and compliance. The attorney will help develop the ESA Program and provide ongoing legal support.
Responsibilities- Perform advanced legal research, interpreting and applying state and federal laws, statutory context, cases, AG opinions, rules, and legislative history.
- Provide clear, concise, timely, and accurate legal advice to senior and executive‑level agency staff, establishing effective working relationships.
- Draft well‑researched legal memoranda, complex legal documents, agency forms, publications, and other materials to ensure accuracy and compliance.
- Collaborate with subject matter experts to draft clear and concise legislation and administrative rules.
- Draft clear and concise executive and other taxpayer and citizen correspondence.
- Contribute to special project research, analysis, and reviews; assist with special projects and other duties as assigned.
Minimum Qualifications
- Graduation from an accredited law school with a J.D. degree (or equivalent). Transcripts are not required; candidates must be licensed to practice law in Texas.
- Nine (9) years of experience as a licensed attorney with advanced legal research in a complex area of law.
- Licensed as an attorney in the State of Texas.
- Good standing with the State Bar of Texas and eligibility to practice law in Texas by the start date.
- Experience researching complex areas of federal law.
- Experience researching federal constitutional law.
- Experience providing legal support to a grant‑making program.
- Experience providing legal support related to education law.
- Experience drafting legislation and administrative rules.
Possess an active license in good standing to practice law in the State of Texas.
