OverviewDraft, review, negotiate and provide legal advice regarding commercial real estate contracts and related documents, including litigation and coordination of all legal activities related to Store Development. Deliver world‑class customer service to internal and external customers while performing other related tasks.
Typical Duties and Responsibilities- Lead the preparation and negotiation of purchase agreements, ground leases, building leases, development agreements, easements, declarations, use restrictions, and other transactional documents.
- Manage all transactional aspects of commercial development for in‑house projects and those assigned to outside counsel.
- Handle entitlement matters related to land use and commercial property development.
- Review construction contracts and other agreements to ensure favorable terms.
- Supervise paralegals on real estate and construction projects.
- Oversee outside counsel for land use approvals and related litigation, managing fees and budgets.
- Review due diligence materials, including title reports, surveys, conveyance documents, and other real‑estate matters.
- Coordinate with developers, outside counsel, and internal departments.
- Handle a high volume of real‑estate and construction transactions (over 50 concurrently).
- Advise on private property rights, trespass laws, and petitioner/solicitor activities on company property.
- Provide counsel on Title III (public access) ADA issues and related litigation; manage such litigation.
- Assess facts and business terms, apply legal principles, and confidently convey advice.
- Research legal issues and stay current on real‑estate and construction trends and risks.
- Suggest ways to improve financial savings and performance while minimizing risk.
- Perform additional duties as required.
- Juris Doctorate and admission to the bar in at least one state.
- At least five years of legal experience in a law firm or in‑house setting.
- At least three years in real‑estate transactions and/or construction contracts.
- Proven drafting and negotiating commercial real‑estate agreements.
- Strong knowledge of real‑estate and related laws with the ability to provide sound, practical advice.
- Familiarity with private property rights and trespass laws on private property.
- Leadership ability and effective collaboration across the organization.
- Excellent organizational, analytical, and communication skills.
- Integrity and unquestionable ethics.
- Presentation and interpersonal skills.
- High level of maturity, presence, and discretion with sensitive information.
- Work in a fast‑paced environment with quick turnaround.
- Prioritize multiple tasks and manage time to meet deadlines.
- Identify legal or contractual issues and develop innovative solutions.
- Provide legal advice to senior management on real‑estate matters.
- Stay current on federal and state laws.
- Work independently with minimal supervision.
- Assist in litigation case management from inception to settlement.
- Travel occasionally as needed.
- Experience with commercial property development in a law firm or corporate environment.
