the department of labor relations (dlr) is a neutral agency charged with administering the commonwealth's collective bargaining statutes. The department exercises jurisdiction over public sector employers in massachusetts and the labor organizations that represent their employees pursuant to m.g.l.

C.150e and m.g.l.

C.150a. In addition, the dlr's jurisdiction extends to a small number of private sector employers who do not fall under the jurisdiction of the national labor relations board as well as administration of m.g.l.

C.150f pertaining to transportation network drivers.

the dlr is seeking applicants for a counsel ii (hearing officer/arbitrator/mediator) position. Although the position will be primarily assigned to the dlr's boston office, travel to the dlr's springfield and worcester offices and throughout massachusetts may be required.

duties include but are not limited to:

  • conduct in-person and video conference investigations of unfair labor practice charges filed pursuant to m.g.l.

    C.150e, m.g.l.

    C.150a and m.g.l.

    C.150f.
  • conduct in-person administrative law and arbitration hearings of prohibited practice charges filed under m.g.l. C 150e, m.g.l. C 150a, and m.g.l.c.150f.
  • conduct arbitration hearings filed pursuant to m.g.l.

    C.150e and m.g.l.

    C.150a.
  • evaluate facts and law, draft and issue complaints, dismissal letters, hearing officer decisions, and arbitration decisions.
  • conduct research, write memoranda of law, and perform information officer duty.
  • investigate representation and written majority authorization petitions field pursuant to m.g.l.

    C.150e, m.g.l.

    C.150a or m.g.l.c.150f and draft decisions.
  • provide contract, grievance and unfair labor practice mediation services.

requirements: the position requires a demonstrated ability to conduct administrative law and arbitration hearings and probable cause investigations and to facilitate the informal resolution of cases during their investigatory and adjudicatory phases; experience in trials or hearings and matters of evidence; and the ability to write decisions of publishable quality.

evening work and travel within the commonwealth may be required. Applicants must have a current and valid motor vehicle driver’s license.

preferred qualifications: excellent academic qualifications, demonstrated writing ability and a minimum of three (3) years of labor law experience, including litigation is required.

eligibility

applicants must have a juris doctor (jd) degree, admission to the massachusetts bar and at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

driver's license requirement

incumbents may be required to have a current and valid motor vehicle driver's license at a class level specific to assignment.
