SUMMARY OF JOB PURPOSE

The Chief Civil Deputy District Attorney provides a wide variety of highly complex and specialized professional legal services. Employees of the District Attorney’s Office are mandatory reporters per NRS 432B.220. This position has a reduced caseload and has additional job responsibilities above the Deputy District Attorney position.

Normal working hours are Monday through Friday, 8:00 am to 5:00 pm, with the understanding these hours are subject to change effective July 1, 2022, per AB424 which states Nevada must have bail hearings within 48 hours.

ESSENTIAL FUNCTIONS

An employee in this position may be called upon to do any or all of the following essential functions:

  • Acts as General Counsel for the County.
  • Oversees the Child Support Division.
  • Advises County agency on legal questions.
  • Prepares civil pleadings.
  • Prepares and reviews contracts.
  • Attends County Board meetings and advises on questions of open meeting law.
  • Reviews law enforcement reports, draft charging, and related documents.
  • Advises law enforcement on legal questions. Observes law enforcement interviews as needed.
  • Prepares adult and juvenile cases for court hearings.
  • Prosecutes cases before the family court, justice, and district courts.
  • Draft and present appellate briefs and arguments before the Nevada Appellate Court and the Nevada Supreme Court.
  • Attends meetings, conferences, and trainings as requested which may include travel.
  • Analyzes cases and applicable laws, codes, and regulations to formulate negotiated offers and sentencing recommendations.
  • Plans, directs, coordinates, and reviews the work of subordinate staff in the preparation of cases for hearings and trials. Evaluates staff performance.
  • Conducts preliminary evaluation of cases. Assigns, oversees, and reviews cases. Supervises and reviews the preparation and presentation of evidence in criminal cases.
  • Supervises attorneys. Ensures appropriate handling of cases and the provision of quality professional legal services.
  • Aids, advice, and counseling to other attorneys with regard to issues in specified areas of expertise and legal strategy.
  • Reviews settlement offers.
  • Supervises plea negotiations between assigned attorneys and opposing attorneys when deems to be necessary in consultation with the district attorney.
  • Provides for appropriate training of attorneys.
  • Handles internal conflict within the department. Recommends potential personnel actions to the district attorney.
  • Maintains up-to-date knowledge of the latest information, techniques, and developments in the legal field.
  • Represents the department with dignity, integrity, and a spirit of cooperation.
  • Juris Doctorate required
  • Any combination of training, education and experience that would provide the required knowledge, skills and abilities
  • Must be a member of the State Bar of Nevada
  • Must maintain a valid Nevada driver's license
  • Must maintain any required approvals and designations as required

  • Thorough knowledge of the rules of civil and appellate practice.
  • Thorough knowledge of child support statutes related to the enforcement of child support.
  • Thorough knowledge of the open meeting law.
  • Thorough knowledge of ethical obligations for public officers.
  • Thorough knowledge of statutes governing counties and county public officers.
  • Thorough knowledge of the principles, methods, materials, and practices of legal research.
  • Thorough knowledge of the public attorney’s collective bargaining agreement, Elko County policies and the Elko County District Attorney’s Office Policy Manual.
  • Thorough knowledge of public contracts.
  • Working knowledge of Nevada election laws.
  • Working knowledge of Nevada tax law.
  • Working knowledge of modern office practices, procedures, and regulations.
  • Working knowledge and correct usage of business English including spelling, grammar, punctuation, vocabulary, and formats.
  • Working knowledge of business correspondence formats, record keeping, report preparation, filing methods and records management techniques.
