Position: Assistant City Prosecutor - Limited Duration

Position Overview

Assistant City Prosecutor, Limited Duration – assist City Prosecutor and Deputy in municipal violations, misdemeanor cases, civil hearings and appeals, including jury and non‑jury trials at Eugene Municipal Court. Perform duties within municipal court policies and legal standards, advise and interact with related City departments.

City Prosecutor, Asst. – hourly $42.04 – $54.64; annually $87,443.20 – $ (Oregon Equal Pay Act consistent).

City Prosecutor's Office, 99 West 10th Avenue, Eugene, Oregon – Monday – Friday, 8:00 a.m. – 5:00 p.m. (flexibility per business need).

Responsibilities
  • Serve as prosecutor on assigned cases, represent City for city code and state statute offenses filed in Eugene Municipal Court, including misdemeanor (traffic and ordinance), violations, probation violations, contempt hearings, trial status report sessions, and removals to Circuit Court. Involve all jury cases and non‑jury cases where defendant has attorney.
  • Prepare and try criminal cases, conduct trial preparation and case work: review police reports; interview witnesses and complainants to determine filing criminal charges; evaluate and file; provide discovery to defendants and attorneys; ensure subpoenas served to essential witnesses; maintain required timelines.
  • Negotiate with defendants and/or attorneys; consult with involved officer(s) and victim(s).
  • Provide prosecution services at in‑ and out‑of‑custody arraignments and settlement conferences.
  • Attend pretrial conferences with defendants, defense attorneys and judges; negotiate settlements.
  • Assist with conducting specific and comprehensive analyses of wide range of municipal court case issues; research and draft legal opinions and memoranda in response to defense motions; initiate motions on behalf of City.
  • Propose amendments or dismissals of complaints for good cause to Court.
  • Determine and recommend amounts and appropriateness of restitutions to be paid by defendants to victims; monitor compliance with ordered restitution payments.
  • Work closely with City Prosecutor, Deputy City Prosecutor, Court Administrator, Municipal Judges, and contracting attorneys; advise Municipal Court of any changes in case status, including plea negotiations, dismissals or amendments.
  • Monitor new developments in criminal case law and procedures and legislation.
  • Participate in advising Eugene Police Dept personnel on questions involving criminal prosecution, such as evaluating sufficient evidence, advising on basis for citing or arresting, and other issues related to criminal prosecution.
  • Participate in court problem resolutions.
  • Draft and review court‑related forms.
  • Establish and maintain effective communication with court staff, police, judges, and indigent defense counsel.
  • May answer questions and provide public information on policy, procedure and case information.
  • Assist with planning, organizing, and implementing alternative approaches to prosecution activities.
  • Assist with preparation of administrative reports on prosecution office activities.
  • Compile and submit victim assistance report.
  • May be responsible for selection, supervision and evaluation of assigned staff; assign work and ensure appropriate training; investigate complaints; recommend and administer disciplinary actions; handle sensitive personnel matter and recommend grievance responses; exercise full supervision over employees.
  • Perform related duties as assigned.
Qualifications
  • Minimum Qualification – Two years of legal experience as an attorney, including at least six months courtroom experience in criminal law.
