Position SummaryThis Fair Hearing Attorney position is under the direct supervision of the Attorney Supervisor, in the Office of the General Counsel, and provides legal representation to the Agency for Persons with Disabilities (Agency) in the area of consumer services and supports and Medicaid‑related litigation in various forums before the Department of Children and Families Office of Appeal Hearings, the Division of Administrative Hearings, as well as other state or appellate courts, as required.
TheWork You Will Do
The Fair Hearing Attorney will represent the Agency’s regional and state office staff who determine program eligibility and levels of services and supports for the Home and Community‑Based Services (HCBS) iBudget Waiver program, and related Medicaid determinations by the Agency, for individuals with qualifying developmental disabilities. The Fair Hearing Attorney will analyze Waiver legal issues and provide legal advice and guidance.
The Fair Hearing Attorney will provide training to Agency staff as needed on Waiver procedures and hearings.
The Fair Hearing Attorney’s representation of the Agency shall be conducted with a high degree of professionalism. The Fair Hearing Attorney shall exercise sound independent professional judgment, with a minimal amount of supervision, in a manner that is timely, well‑researched, thorough, and diligent.
The Fair Hearing Attorney shall perform a variety of complicated legal services, including analyzing legal issues, providing sound legal advice and guidance on complex Agency issues, and timely responding to oral and written requests from Agency personnel, as directed by the Attorney Supervisor, or other OGC leadership.
The Fair Hearing Attorney shall adequately explore the underlying facts, engage in discussions with appropriate staff, carefully research the law, as applicable, to furnish proper legal guidance to the Agency.
The Fair Hearing Attorney shall conduct legal research, interpret statutes, review regulations, rules, relevant handbooks, operating procedures, as necessary, to carry out professional duties and responsibilities in advising the Agency in legal matters.
