Role OverviewThis position provides competent legal representation on behalf of the ratepaying public primarily before the Indiana Utility Regulatory Commission (“IURC”) and occasionally other regulatory bodies, as well as state and federal courts. Duties are performed with little or no supervision, and the position requires self-motivation, discipline, and initiative. Reports directly to Chief Deputy Consumer Counselor.
Salary StatementThe salary for this position traditionally starts at $83,037.00 but may be commensurate with education or work experience.
Essential Duties/Responsibilities- Advocates and represents the interests of ratepayers in utility proceedings (trials) usually before the IURC.
- Prepares and presents witnesses and exhibits in evidentiary hearings; cross examines witnesses from utilities or other interested parties; drafts legal pleadings, trial and appellate briefs, motions and proposed orders; conducts discovery; participates in settlement negotiations.
- Works closely with technical staff assigned to case.
- Works closely with Leadership to develop and carry out Agency policy.
- Contributes to the achievement of overall Agency and Division goals.
- Learns and identifies current utility regulatory practices.
- Drafts and edits testimony.
- Participates in occasional IURC field hearings at various locations throughout the state.
- Reviews orders from the IURC, FERC, Indiana Supreme Court and Court of Appeals orders, and other utility jurisdictions as well as utility periodicals to keep informed of utility issues.
- Attends continuing legal and technical seminars/conferences.
- Analyzes proposed legislation.
- Assists External Affairs Director in drafting accurate press releases.
- Engages in continuous personal and professional development.
- All other duties assigned.
- JD degree; admission to the Indiana bar; and an attorney in good standing before the Supreme Court of Indiana.
- General competence in litigation, including a thorough understanding of applicable rules of evidence and trial procedure.
- Ability to present complex evidence to the tribunal in a persuasive manner.
- General knowledge of accounting, finance, economics, and engineering.
- Must be able to manage multiple tasks and engage in creative problem solving.
- Ability to communicate effectively both orally and in writing.
- Ability to make reasoned recommendations to agency Leadership.
- Ability to establish and maintain effective working relationships with colleagues, technical consultants and the public.
- Ability to become fully conversant with Title 8 of the Indiana Code and Title 170 of the Indiana Administrative Code.
Highly specialized complex litigation that is presented in hearings before the Indiana Utility Regulatory Commission; in-house technical analysts are available to assist in the presentation of evidence; must possess the ability to handle a fairly diverse case load in a fairly expedited manner. Must be able to manage multiple tasks.
Case ResponsibilityGenerally, first or second chair case responsibility depending on the complexity of the issues in the case and the experience of the attorney; limited supervision; generally makes strategy decisions in particular cases, but all Agency policy decisions are made after consultation with appropriate leadership members.
