DescriptionThe Administrative Law Judge, under the title of Motor Vehicle Referee, will be engaged in professional legal work conducting administrative hearings and rendering decisions for the adjudication of moving traffic violations, as well as those involving fatal accidents, persistent violators, false statements on Motor Vehicle documents, or driving without insurance. They will also conduct hearings involving charges of violations of the Vehicle and Traffic Law and the Commissioner’s Rules and Regulations by commercial establishments such as repair shops, dealers, inspection stations, driving schools, commercial bus drivers and school bus operators.
In some cases, the incumbent will prepare cases for review by the Motor Vehicle’s Appeals Board. Additionally, the incumbent will render decisions for violations of the Navigation Law by boaters, and the Parks, Recreation and Historic Preservation Laws by operators of snowmobiles. Decisions are also influenced by the Zero Tolerance Program and new regulations concerning emission inspections.
- Conduct administrative hearings and render decisions for traffic violations, fatal accidents, persistent violators, false statements, driving without insurance, and other vehicle-related offenses.
- Handle violations of the Vehicle and Traffic Law, Commissioner’s Rules and Regulations, and commercial establishment violations.
- Prepare cases for review by the Motor Vehicle Appeals Board.
- Render decisions for Navigation Law violations by boaters and Parks, Recreation and Historic Preservation Laws violations by snowmobile operators.
- Apply Zero Tolerance Program guidelines and emission inspection regulations in decision making.
- Administrative Law Judge (Motor Vehicle Referee) (SG‑25):
Admission to the NYS bar and two years of post‑licensure professional legal experience. - Assistant Administrative Law Judge (Assistant Motor Vehicle Referee/Assistant Motor Vehicle Referee, Spanish Language) (SG‑22): 12 months as an Assistant Attorney 2, or admission to NYS Bar and 12 months of satisfactory legal experience in the trial of issues in courts of record or conduct of quasi‑judicial proceedings before a governmental department or agency.
One year of permanent or eligible service allocated to a Grade 21 or higher is required for transfer, as defined by Civil Service Law sections 52.6 and 70.1. Reinstatement is available for former employees under Civil Service Law provisions, with approval requirements based on time away from state service.
55b/c Appointment EligibilityPosition is eligible for 55b/c designation; candidates with 55b/c eligibility are encouraged to apply. Candidates must possess minimum qualifications and a current 55b/c eligibility letter.
Preferred Qualifications- At least three years’ experience as a New York State Attorney.

- Excellent oral communication skills.
Positions available in all five Metro Counties (New York, Bronx, Kings, Richmond, and Queens). Employees working in the five boroughs of New York City or in Nassau, Suffolk, Rockland, or Westchester Counties receive an additional $4,000 annual downstate adjustment.
Hours of the position will be discussed at the time of interview, including questions regarding flextime, compressed work week, and telecommuting.
