The Office of Administrative Trials and Hearings (OATH) is the nation’s largest administrative tribunal, handling approximately 400,000 trials and hearings each year. As the City’s central, independent administrative law court, OATH adjudicates a wide range of matters brought by nearly every city agency, board, and commission. OATH also houses the Center for Creative Conflict Resolution and the Administrative Judicial Institute, which provide mediation, restorative justice support, training, and research for city government and the public.
Job DescriptionThe OATH Trials Division seeks one Law Clerk to provide legal research and writing support to the OATH Administrative Law Judges. The Law Clerk may also be designated by the Chief Administrative Law Judge to conduct pre‑trial settlement conferences in certain proceedings.
Responsibilities- Maintain a caseload of matters before numerous agencies, including the Loft Board and the Contract Dispute Resolution Board; review submissions, draft legal notices and memoranda, organize conferences and oral arguments, and communicate with parties, the Chairperson, and panelists.
- Proofread and cite‑check draft reports, recommendations, and memorandum decisions.
- Perform legal research related to statutory and regulatory issues, reviewing state and federal court case law and OATH Trials Division precedent.
- Review parties’ legal arguments, presentations of facts, and exhibits, and write legal memoranda and draft reports and recommendations, including decisions on motions, for review by the Supervising Law Clerk and Administrative Law Judges.
- Participate in meetings and discussions with other Law Clerks and the Administrative Law Judges.
- Maintain an organized docket of assignments and meet deadlines assigned by the Administrative Law Judges and the Supervising Law Clerk.
- Engage in correspondence and communications with attorneys, agency representatives, and pro se respondents as needed.
- Draft OATH Trials Division monthly newsletter, Bench
NOTES, and summarize cases for that newsletter and other publications such as The New York Law Journal; update and upload cases for publication in the City Admin online legal research library and Lexis. - Update legal research databases and memoranda.
- Work with other divisions and units of OATH.
- Respond to requests for information regarding OATH records, transcripts, and other materials maintained by OATH.
Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.
Preferred SkillsPreference will be given to candidates who can demonstrate excellent writing, legal research, analytical skills and an established interest in administrative law.
Work ArrangementHybrid office / remote work schedule available after initial training period, subject to the needs of the tribunal.
Salary$72,510.00 – $72,510.00.
