Senior Legal Counsel - Intellectual Property

Our client, a rapidly expanding technology firm, is seeking a highly accomplished Senior Legal Counsel with specialized expertise in Intellectual Property (IP) law. This is a fully remote position, offering a unique opportunity to work from anywhere in South Africa and play a pivotal role in protecting and managing the company's valuable IP assets. You will be responsible for advising on all aspects of IP law, including patents, trademarks, copyrights, and trade secrets.

This includes managing IP portfolios, drafting and negotiating IP-related agreements, conducting IP due diligence, and contributing to IP litigation strategy. The ideal candidate will possess a deep understanding of IP law, strong strategic thinking, and the ability to excel in a dynamic, fast-paced remote environment. Your guidance will be crucial in driving innovation and securing the company's competitive advantage.

• Manage and protect the company's global intellectual property portfolio (patents, trademarks, copyrights, trade secrets).
• Conduct IP due diligence for mergers, acquisitions, and strategic partnerships.
• Draft, review, and negotiate IP-focused agreements, including licensing, R&D, and joint venture agreements.
• Advise on patentability, trademark registrability, and copyright protection strategies.
• Oversee the prosecution of patent and trademark applications globally.
• Develop and implement IP enforcement strategies and manage infringement matters.
• Provide legal counsel on open-source software compliance and data privacy related to IP.
• Collaborate with R&D, product development, and marketing teams to align IP strategy with business goals.
• Stay abreast of evolving IP laws and trends worldwide.

• A Bachelor of Laws (LLB) degree or equivalent qualification.
• Admitted as an Attorney of the High Court of South Africa.
• A minimum of 8 years of post-qualification experience, with a substantial focus on intellectual property law.
• Proven experience in managing patent and trademark portfolios, IP licensing, and IP litigation.
• Strong understanding of patent law, trademark law, copyright law, and trade secret law.
• Excellent drafting, negotiation, and analytical skills.
• Demonstrated ability to work independently, manage complex IP matters, and lead projects in a remote setting.
• Exceptional communication and interpersonal skills, with the ability to advise technical and business teams.
• Admission as a Patent Agent is a significant advantage.
