Federal law maintains that each state is responsible for "maintaining qualifications to ensure that personnel necessary to carry out this part are appropriately and adequately prepared and trained, including that those personnel have the content knowledge and skills to serve children with disabilities" [IDEA Act, 20 U.S.C. § 1412 (2004)].
Both the Individuals with Disabilities Education Act (IDEA) and Every Student Succeeds Act (ESSA) outline expectations for school districts to properly train and supervise paraprofessionals. Title I of the ESEA, as amended by NCLB, requires paraprofessionals serving in an instructional capacity to meet higher standards, including:
- Having earned a secondary (high) school diploma or recognized equivalent;
- Having completed at least two years of higher education;
- Obtaining an associate’s degree or higher; or
- Meeting a rigorous standard of quality demonstrating knowledge and ability to assist in instruction, such as passing the ETS Para Pro Assessment with a score of 464.
