Job Summary

The Deputy Prosecutor I provides professional legal services, which include prosecuting felony, misdemeanor, and/or juvenile cases, making charging decisions, negotiating case settlements, and assisting the County Prosecutor with other legal and administrative work necessary to achieve the objectives of the office. The position provides general direction to assigned legal and other assistant support positions but is not a supervisory position. While the work is performed under the general supervision and authority of the County Prosecutor, there the position is expected to exercise independent judgment, initiative, and discretion to manage the assigned caseload.

Essential Duties and Responsibilities

The Deputy Prosecutor I assumes daily responsibility and performs tasks in the following areas:

  • Investigates, prepares, and manages felony, misdemeanor, and/or juvenile cases for trial, including but not limited to: reviewing charges and evidence, conducting legal research, interviewing affected parties, preparing required legal and court documents, preparing, and arguing briefs, and attending court proceedings
  • Makes charging decisions following review and evaluation of police reports and other evidence and in consideration of applicable law
  • Negotiates case settlements with opposing counsel
  • Advises and consults with police officers, detectives, attorneys, defendants, victims, witnesses, and other interested and affected parties
  • Represents the County's interest in court
  • Answers communications from the public relative to legal matters affecting the County
  • Performs all work duties and activities in accordance with County policies, procedures, and safety practices
Other Duties and Responsibilities
  • May be assigned on call after regular hours to respond to emergency situations, or other duties as assigned or necessary to aid the department in the completion of its objectives
Competency Requirements

The Deputy Prosecutor I obtains, possesses, and deploys the following knowledge, skills, and abilities to effectively perform their responsibilities:

Knowledge Of
  • Legal, court, and judicial procedures, rules, terminology, methods, documents, practices, and objectives typically used in a courtroom environment
  • Applicable federal, state, and municipal laws, statutes, ordinances, and code needed for practice of the assigned caseload and duties, and their application to county government
  • Legal research methods and applications used to determine established precedents and sources of legal references applicable to the County caseload and current legal issues
Skill To
  • Analyze evidence, organize facts, identify precedents, weigh alternatives, and anticipate possible to develop and deploy an appropriate legal strategy and logical argument(s)
  • Appear without assistance in court and other judicial proceedings and be able to present evidence, arguments, testimony, and witnesses before a judge or jury
  • Negotiate complex legal issues with opponents, and bring interested and affected parties to consensus
  • Operate standard office equipment, including a personal computer, printer/scanner, and job-related software applications
  • Make significant/substantial legal decisions in individual cases based on a combination of factors including the law, policy, and rules of ethics
Ability To
  • Communicate effectively, both orally and in writing, for purposes of advocating, persuading, negotiating, and counseling for or on behalf of the County
  • Maintain a professional demeanor during all situations, and maintain effective working relationships with other County employees, staff, attorneys, law enforcement personnel, victims, witnesses, supervisory personnel, agency stakeholders, state and local elected and appointed officials, and the public
  • Perform a wide variety of duties and responsibilities with accuracy and speed under the pressure to meet time-sensitive deadlines, and be able to perform multiple tasks simultaneously, manage case priorities, including handling interruption and change
  • Demonstrate character, integrity, and ingenuity in representing the County
