ABOUT THE JOB
:
Reporting to the Director of Procurement, the Assistant Director for Contract Compliance will implement best practice compliance strategies through contract and project monitoring, data analysis, reporting, training, technical assistance, and vendor outreach. This position manages all aspects of BHA’s Minority and Women-Owned Business Enterprise (M/WBE) and Section 3 Compliance Programs. Including monitoring compliance throughout the duration of all covered activities ensuring that both programs’ requirements are met for contract awards, periodic payments, and final disbursements.
As the primary authority on contract compliance under these programs, this role will collaborate with BHA departments, residents, businesses, and recipients to coordinate BHA’s contract compliance efforts and related activities. In partnership with the Legal Department, this role will develop and implement forms and procedures for use in BHA’s procurement, contract administration, and compliance plan.
Additionally, this position will assist the BHA Planning, Construction and Development departments with Supplier Diversity compliance, specifically administer the M/WBE and Section 3 policy and well as future contracting policies
Duties & Responsibilities:
Manages all aspects of BHA’s Minority and Women-Owned Business Enterprise (M/WBE) and Section 3 Compliance Programs, such as:
- Supervises Contract Compliance staff, fellows and interns.
- Directs the implementation of certified payroll monitoring and compliance activities.
- Oversees the implementation and management of the Minority and Women-Owned Business Enterprise Participation Policy (M/WBE) and the Section 3 Policy.
- Assists in the maximization of MWBE and Section 3 Business participation in all contracts awarded by the Authority.
- Promotes Section 3 hiring from BHA program participants, including but not limited to tenant coordinators on construction projects.
- Monitors compliance and enforcement of the M/WBE Program and analyzes workforce composition goals.
- Monitors recipients’ performance in meeting Section 3 and M/WBE goals.
- Asses and address disparities in contracting to ensure fair, open and competitive procurements and fair use of public resources.
- Ensure workers on BHA-funded construction projects are advised of wage standards required by law, regulation, or contract.
- Monitors subcontracting and employment practices of contracting firms for compliance with relevant law and with contract provisions.
- Provides technical assistance and training to all stakeholders regarding certified payroll reporting, MWBE and Section 3 requirements and best practices to ensure full compliance with regulatory and program mandates for all contractors, sub-contractors, designers, and MBE's/WBEs doing business with BHA.
- Works closely with vendors, including MWBEs and Section 3 Businesses, to foster their ability to bid successfully on Authority contracts.
- Works closely with relevant departments on developing solicitations for Authority procurements, including Request For Proposals (RFP) and Discretionary Procurements, in order to enhance contracting opportunities.
- Assists with the collection, review and compilation of data that will inform various progress reports required by State oversight entities and other reporting needs.
- Makes recommendations to policies and procedures to increase the utilization of Section 3 and MWBE certified firms.
- Consults with and makes recommendations to BHA’s Legal Department with respect to M/WBE and Section 3 Program compliance-related issues, imposition of sanctions, and the processing of Program–related public records requests.
- Makes and issues written determinations regarding BHA Section 3 Program compliance with respect to proposed contract awards.
- Investigates complaints from Section 3 Workers, Targeted Section 3 Workers, and Section 3 Business Concerns.
