Labor Standards Analyst

The Department of Workforce Services is seeking a Labor Standards Analyst to investigate, evaluate, and issue written determinations through complex case analysis and independent adjudication of federal and state violations of civil rights laws and wage and hour laws. The incumbent will alleviate the burden on the Court System through informal and formal administrative procedures, including alternative dispute resolution, to resolve violations of State and Federal anti-discrimination and wage & hour laws.

The incumbent will exercise considerable independent discretion and judgment within statutory limits.

Essential functions:

  • Advises claimants, charging parties, the public, workforce centers, attorneys, employers, and others concerning labor laws, unfair/illegal employment practices, wage and hour laws, and all other statutes enforced by Labor Standards.
  • Investigates and issues determinations on claims for wages.
  • Investigates and issues decisions on charges of employment discrimination. This includes legal analysis based upon current case law.
  • Investigates and issues determinations on the Wyoming Labor Preference Act.
  • Conducts alternative dispute resolution conferences (fact finding/settlement conferences) with authority to negotiate settlements on wage claims and charges of employment discrimination.
  • Conducts site visits on charges of employment discrimination.
  • Prepares an investigative plan and issues requests for information to parties in a claim or charge.
  • Investigates complaints involving child labor violations, issues findings, and recommendations for compliance and possible referral to the U.S. Department of Labor.
  • Upon request of the Program Manager or the Division Administrator, may investigate objections to a resident contractor's certification and report findings back to the Program Manager or Administrator.
  • Investigate the state prevailing wage act violations, which mandate set wages to be paid on state public works projects.
  • Provides training on employment law to the general public, employer groups, and employee groups.
  • Investigate discrimination charges, draft discovery requests, interview witnesses, draft and negotiate settlements, request and draft subpoenas, write determinations, and conduct fact finding/settlement conferences.
  • Take complaints of wage and hour violations, contact employers, conduct on-site visits; advise, consult, assist, and provide technical support to lawyers, unions, employers, and employees to be paid on state public works projects.
  • Provides training on employment law to the general public, employer groups, and employee groups.
  • Investigate discrimination charges, draft discovery requests, interview witnesses, draft and negotiate settlements, request and draft subpoenas, write determinations, and conduct fact finding/settlement conferences.

  • Conduct legal research, review, analyze court decisions, statutes, regulations, codes, and rules, and apply considerable judgment to fair employment and wage and hour cases.
  • Review employment policy handbooks upon employer request as assigned by the Program Manager.
  • Functions as an EEO Counselor for the Wyoming Military Department.

Preferences:

  • Preference may be given to those with experience and knowledge of Employment Law and Human Resources Management.
  • Preference may be given to those with Mediation and Negotiation techniques, and interpersonal communications are preferred.

Knowledge:

  • Knowledge of state and federal labor laws, including wage and hour statutes, Title VII, ADA, ADEA, and EPA.
  • Knowledge of Labor Standards Program procedures and applicable rules and regulations.
  • Knowledge of laws, practices, principles, and concepts regarding federal/state civil rights, labor relations, wage and hour, equal pay, age, race, sex discrimination, disability discrimination, family and medical leave, plant closing, and other labor laws.
  • Knowledge of public works contracts, unions, state preference, and prevailing wage.
  • Knowledge of basic principles/practices of business accounting.
  • Knowledge of how to conduct audits of complex payroll records and other employer documents.
  • Knowledge of mediation and negotiation techniques and interpersonal communications.
  • Knowledge of the Wyoming Administrative Procedures Act.
