The North Carolina Department of Public Instruction (NCDPI) is charged with implementing the state's public school laws for pre-kindergarten through 12th grade public schools at the direction of the State Superintendent of Public Instruction and State Board of Education.
** Description of Work
*** This position is Exempt Policy making and is EXEMPT from certain provisions of the State Human Resources Act (GS 126).
* The Assistant General Counsel, under the direction and supervision of the General Counsel, provides professional legal advice, support, and representation to the State Board of Education (“State Board”) and the Department of Public Instruction (“Department”).
The Office of General Counsel provides in-house legal services to both the State Board and the Department of Public Instruction, which carries out the day-to-day work of the State Board.
Job Responsibilities:
Prepare and assist with negotiating legal documents, including contracts, memoranda of agreement/understanding, procurement paperwork, settlement agreements, responses to Federal and State complaints, and others.
Assist with public records requests and ensuring compliance by the State Board and Department with all relevant open meetings and public records statutes.
Researches, advises on, and develops policies and procedures in collaboration with State Board and Department staff.
Collaborate with Technology Services, Purchasing & Contracts, and other state agencies.
Provide legal advice to State Board and Department leadership, advisors and staff on issues, including governance, ethical obligations, conflicts of interest, business and finance, risk management, liability, and other issues impacting the statewide education system.
Provide analysis of federal, state and local policies impacting public education. Assist State Board and Department staff in the policy-development process.
Respond to agency and public inquiries concerning these legal issues, and advise the Department as to its obligation, duties, authority, and liability.

*** Knowledge of case, statutory, regulatory, and common law.
* Knowledge of judicial and quasi-judicial procedures.
* Perform legal research in accordance with initial guidance as to methods of approach, source materials available, and policy and precedent of the Office of General Counsel, State Board, and Department.
* Understand and interpret constitutional provisions, statutes, administrative regulations, and case law.
* Analyze facts, evidence, and legal instruments.
* Express conclusions and arguments clearly and logically in oral and written form.
* Maintain effective working relationships.

The State Board sets policy and general procedures for the public school system, including teacher pay and qualifications, the Standard Course of Study for Kindergarten through Grade 12, statewide testing requirements.
