JOB SUMMARY:

Under the supervision of a Senior Assistant Prosecuting Attorney, the Deputy Chief Assistant Prosecuting Attorney, Chief Assistant Prosecuting Attorney or Prosecuting Attorney; represents the Prosecutor's Office in family support matters. This includes, but is not limited to, conducting intake interviews; initiating paternity or child support cases; conducting legal research; attends hearings; drafting complaints, motions, affidavits, notices, child support calculation, orders establishing paternity and child support and Uniform Child Support Orders.

Employees make assignments to staff, evaluate job performance and participate in the hiring and training of personnel.

EXAMPLES OF DUTIES

  • Supervises and monitors the activities of legal assistants, paralegals and the investigator.
  • Conduct intake interviews with custodial parents or parties and determine whether a paternity and/or child support case should be filed.
  • Conducts interviews with the custodial and non-custodial parents to establish paternity or child support orders. Obtain information that is necessary to determine a fair and appropriate level of child support.
  • Consult various computer programs to locate non-custodial parents.
  • Becomes proficient at using the Michigan Child Support Enforcement System.
  • Becomes proficient at using the resources available in MiSupport, including but not limited to Business Objects, VERA, Electronic Document Exchange, Federal Child Support Portal and memorandum and updates from the Office of Child Support.
  • Attends and presents evidence in formal hearings on paternity and child support issues, and possible trial work.
  • Handles interstate cases by initiating requests to other states and responding when we are asked to pursue paternity and/or child support.
  • Corresponds with other state tribunals and out of state stakeholders
  • Completes fingerprinting/background investigation as directed by Michigan Department of Health and Human Services (MDHHS) to ensure employability and funding requirements
  • Conduct research regarding legal issues.
  • Answer questions from non-attorney staff about questions of law, procedure and policy
  • Respond to inquiries from the public about paternity and child support procedure.
  • Respond to inquiries from custodial parties, non-custodial parties, court staff and Department of Health and Human Services employees regarding the disposition or status of cases.
  • Draft complaints, motions, affidavits and orders.
  • Review and sign complaints and motions that are prepared by legal assistants and paralegals.
  • Familiarity with the collection of DNA samples for genetic testing in paternity cases.
  • Enter data into multiple computer systems; scan and index documents into a computer system.
  • Stay abreast of changes in relevant federal and state statutes, regulations, court rules, case law and policies.
  • Participate in PAAM Family Support Forum and other trainings, meetings and conferences throughout the year.
  • Satisfy contractual obligations with the office of child support as articulated in the Cooperative Reimbursement Program.
  • Attend County Board of Commissioners meetings periodically to seek approval of the budget for the Cooperative Reimbursement Program.

EMPLOYMENT QUALIFICATIONS:

Meets all requirements of Assistant Prosecuting Attorney Level including but not limited to:

  • Member of the State Bar of Michigan for at least two (2) years.
  • Two (2) years experience with the Washtenaw County Prosecuting Attorney's Office or two (2) years of equivalent trial experience or civil litigation in another capacity. Examples of other experience that would be satisfactory are the U.S. Attorney's Office, Public Defender's Office, Friend of the Court attorney or Family Law Attorney.
  • Demonstrated ability to fulfill the functions of an Assistant Prosecuting Attorney or Family Law Attorney as determined by the Prosecuting Attorney based upon the attorney's work history as an Assistant Prosecuting Attorney or Family Law Attorney within Washtenaw County or another organization.
PHYSICAL DEMANDS

Duties require sufficient mobility to work in a normal office setting and use standard office equipment including a computer, vision to read printed materials and a computer screen hearing and speech sufficient to communicate in person and over the telephone.
