Position: Counsel to the Inspector General This position is exempt from the State of Delaware Merit System
Location: Milford

Introduction

The Delaware Office of the Inspector General (OIG) recently has been established as an independent and nonpartisan agency to detect and deter fraud, waste, mismanagement, corruption, and any other abuse of governmental resources that harms the public interest.

Summary Statement

The Counsel to the Inspector General is a senior level executive professional who serves as principal legal counsel and advisor to the Inspector General with respect to the operations of the OIG. In coordination with the Inspector General, the Counsel reviews, provides advice, and ensures the legal sufficiency and accuracy of the full range of OIG investigations, reviews, and other products, ensures OIG compliance with all legal requirements, and acts as the primary legal representative of the OIG with other governmental partners, agencies, and outside entities.

The incumbent also assists the Inspector General as directed in leading the operations of the office.

Preferred Qualification

Applicants who do not possess the preferred qualification will still be eligible to compete for this position if job requirements are met.

  • Preference will be given to applicants that have experience working in or knowledge of Delaware state government, including but not limited to state offices, departments, boards, commissions, committees, school districts, and other executive and legislative bodies.
Essential Functions

Essential functions are fundamental, core functions and are not intended to be an exhaustive list of all job duties. Among the essential functions for the Counsel to the Inspector General are:

  • Providing legal expertise, analysis, and advice to the Inspector General and other OIG personnel regarding the full range of OIG operations;
  • Ensuing the legal sufficiency and accuracy of all OIG investigations, reviews, and other work products;
  • Developing memoranda of understanding and other collaborative agreements and arrangements with federal, state, and local oversight partners and serving as the primary point of contact regarding the operations of such agreements and arrangements and relationships with other investigative, prosecution, and oversight entities.
  • Reviewing existing and proposed legislation and regulations and making recommendations to the Inspector General regarding the impact and operation of same.
  • Overseeing the issuance and enforcement of OIG documentary and testimonial subpoenas;
  • Working with other OIG personnel to develop and conduct education and training regarding whistle blower rights and protections and in analyzing and addressing any whistle blower-related issues;
  • Litigating on behalf of the OIG and/or providing primary supervision and engagement with any outside counsel retained by the OIG;
  • Serving as primary ethics advisor for the Inspector General and other OIG personnel.
Job Requirements

Job Requirements for Counsel to the Inspector General

Please submit a cover letter and resume providing a detailed description of how your education, training, and/or experience meets each job requirement including employer, experience/responsibilities and dates (month/year) of employment/training.

  • Education:

    A Juris Doctor (J.D.) from an ABA-accredited law school.
  • Experience:

    Active membership in good standing with the Delaware state bar.
  • Experience:

    At least 10 years professional legal experience post-bar admission.
  • Experience demonstrating strong legal research and writing skills, and the ability to analyze complex legal and factual issues, anticipate investigative and/or litigation challenges, and develop effective strategies to address them.
  • Experience reflecting knowledge of investigative or other oversight practices, evidentiary standards, and applicable statutes and court rules.
  • Experience communicating and engaging effectively with attorneys, investigators, support staff, court personnel, law enforcement and other oversight entities, and other governmental organizations and outside stakeholders.
Additional Posting Information

The incumbent will work at the Warr Building, 60 Loockerman Plaza, Dover, DE 19901, or may also work at the Carvel State Office Building, 820 N. French St., Wilmington, DE 19801 based on and consistent with operational needs.
