Labor Compliance Deputy / AnalystA Labor Compliance Analyst is responsible for providing overall support to publicly funded public works projects, including logging, auditing, and reporting duties. The job involves examining, evaluating, and investigating eligibility for or conformity with laws and regulations governing contract compliance of licenses and permits. The analyst is also responsible for training employees on industry standards, developing policies, and evaluating compliance.
Typical Duties- Assist in the audit and investigation of worker and third-party prevailing wage rate complaints
- Conduct Labor Compliance audits to confirm payment of prevailing wages for covered labor classifications, including validating the timely submittal of union benefits/trustee reports, adherence to apprentice-to-journeyman work ratios, and use of appropriate labor classifications as applicable.
- Perform initial assessment of complaints and allegations of possible Federal and State Labor Code violations by contractors and subcontractors received from a variety of sources.
- Conduct preliminary investigative meetings with contractors and other parties making allegations to determine the validity of complaints that have been made.
- Conduct audits of contractors and subcontractors by traveling to construction sites and interviewing construction workers in the field and other covered labor, reviewing and verifying certified copies of contractors’ payroll records, and reviewing other construction records, logs, and reports for compliance with District regulations and State Labor Codes, completeness, and indications of noncompliance.
- Determine the amount of wages and penalties due for identified violations in conformance with regulatory guidelines.
- Recommend and prepare “Notice to Withhold” documents to facilitate the withhold process of contractors found to be in violation of the prevailing wage requirements and prepare “Release of Notice to Withhold” when a determination of full compliance has been satisfied.
- Respond to technical questions regarding prevailing wage rates and complaint processing requirements from contractors, subcontractors, and complainants and recommends solutions to minor complaints regarding Labor Code violations.
- Prepare and presents oral reports concerning the prevailing wage violation audit for the settlement conference.
- Monitor receipt of wages and penalties paid by out-of-compliance contractors by preparing and submitting documentation identifying the deposit of penalties and forfeitures into the general fund and reconciles account balances with the appropriate District office.
- Prepare various reports regarding matters such as annual dollar amount of penalties collected by project, contractor, and fund type; summaries of prevailing wage violations and new and closed cases, wages withheld, and penalties collected and due; complaints filed, number and status of cases, and money withheld and collected; and other activity reports.
- Coordinate meetings and hearings with the Labor Compliance Officer, Contract Compliance Officer, contractors, complainants, and preservation and community groups regarding prevailing wage violation issues.
- Perform other related tasks and deliverables.
- Bachelor’s Degree
- Valid Class C Driver’s License
- Knowledge at minimum of business software applications including MS Office Suite, project management, Excel, PowerPoint, and Publisher
- Excellent verbal and written communication skills
- Excellent time management and organizational skills
- Knowledge of standard formats for letters, memorandums, reports, and initiate Excel spreadsheets
- Ability to lift and carry up to 30lbs.
