Responsibilities
- Assigned as a Special Assistant Attorney General, individuals prosecute criminal cases containing a SCDC nexus before the SC state grand jury as well as in all judicial circuits throughout the state upon approval by the South Carolina Attorney General's Office.
- Authority to prosecute is pursuant to a memorandum of understanding between SCDC and the AG's office.
- Manages a personal caseload of cases for prosecution.
- Assists special agents on cases by providing advice on search warrants, evidence, and future legal issues etc.
- Assist in determination of documentation to be released to FOIAS, subpoenas, rule 5, etc.
- Produce documents and other information to defendants or their lawyers, upon request and as required by law on cases actively being prosecuted by the Criminal Prosecution Division.
- Must be available to respond after hours in person or by phone to serious crime scenes and emergencies to provide legal advice.
- Research legal issues, prepare briefs and oral arguments.
- Keeps the Division Director and appropriate department staff informed of recent changes in state and federal law.
- Serves as liaison between the solicitor’s offices around the state, the AG's office, attorneys representing individuals in criminal cases, etc.
- Responds to correspondence from attorneys, court officials, state agencies regarding SCDC criminal cases.
- Provides legal advice on criminal matters to the Director, Senior Executive Staff and other agency personnel in matters of state and federal law.
- Provides agency personnel with education and guidance in areas related to criminal issues during in-service training and other forums as directed.
- Assists in drafting legislation and regulations.
- When required, presents information to members of the general assembly, state or federal agencies or constituency representatives.

Minimum RequirementsState of South Carolina
Minimum Requirements:
A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.
SCDC
Minimum Requirements:
- J.D. or equivalent and at least two (2) years of experience as a practicing attorney.
- Must be a member and in good standing with the South Carolina bar.
- Must have satisfied the 403 Requirements.
Prosecutorial experience preferred.
