Please review the following job description:The incumbent is required to independently (or with minimal oversight) bring to efficient resolution attorney represented claims, regardless of the types of allegations, exposure amounts, or the unique circumstances associated with mass litigation. The incumbent is to perform such tasks consistent with strategies, and within settlement authority, set forth or otherwise agreed upon by the Vice President – Claims Litigation.
Following is a summary of the essential functions for this job. Other duties may be performed, both major and minor, which are not mentioned below. Specific activities may change from time to time.
- Maintain the relationships with and timely address Company's clients as it relates directly to attorney represented claims.
- Consistent with the guidance and instruction provided by the Vice President – Claims Litigation, develop and follow individual case and docket strategies in furtherance of Company and client preferences and goals.
- Instruct any retained outside counsel regarding, and promote their compliance with, such litigation strategies; monitor the legal spend of same.
- Appropriately evaluate individual case exposure in accordance with practices promoted by leadership and seek agreement from the Vice President – Claims Litigation for any settlement authority in excess of any agreed upon blanket authority.
- Work with management to develop and/or improve procedures and training.
- Draft and/or critique various forms of communication, such as pleadings, discovery, attorney letters, releases, and affidavits.
- Adjust indemnity reserves based on assessment of case and any changes to possible exposure.
- Keep informed of relevant case law, factors affecting litigation in each venue, and industry trends.
- Identify problems, evaluate solutions, and take action free with little supervision, along with presenting recommendations relating to same to leadership, as appropriate.
- Provide counsel to claim examiners on various issues related to the adjustment of residential property claims.
Required Qualifications:
- Generally, three to four years of first party, residential property insurance coverage experience.
- Juris Doctorate from an accredited law school.
- Must be a licensed attorney.
Preferred Qualifications:
- Residential property insurance coverage experience in the states in which the Company conducts business, including Texas.
- Licensed P&C claims adjuster.
