Responsibilities

The Assistant City Prosecutor prosecutes misdemeanor criminal, civil traffic, and municipal code and zoning cases with the goal of administering justice and advocating for victims' rights. The ideal candidate will possess a minimum of two years’ experience in Prosecution and/or Criminal Defense, as well as experience conducting Bench and Jury Trials, and managing pre-trial conferences. The candidate will need to possess strong communication skills in speaking with represented as well as unrepresented defendants.

A familiarity with Criminal Motion Practice and “Prosecutor by Karpel” or a similar case management system is preferred. Position requires a valid Arizona Bar License in good standing.

Essential functions include multi-tasking in a fast-paced environment, collaborating with a team, and performing duties across case management, trial preparation, victim rights advocacy, and prosecutorial procedures. Responsibilities include initiating charges, reviewing investigations, preparing charges and charging documents, handling arraignments and pre-trial conferences, conducting trials, researching motions, advising law/code enforcement, and participating in competency hearings.

  • Initiates criminal, city code, or probation violation charges; reviews investigations for legal and factual sufficiency; prepares charging documents; notifies victims and educates them about rights; ensures service and warrants.
  • Reviews/prepares cases for arraignments, pre-trial conferences, and probation violations; formulates plea offers; coordinates with victims and witnesses; monitors probation.
  • Conducts arraignments and pre-trial conferences; presents arguments and sentencing recommendations; negotiates plea agreements; ensures defendants understand rights.
  • Prepares cases for trial; subpoenas witnesses; evaluates evidence; discusses case strategy; files pre-trial motions.
  • Conducts bench and jury trials; prosecutes and advocates for victims' rights.
  • Multi-task in a fast-paced environment and collaborate with a team.
  • Reseaches legal motions, appeals, and petitions; writes legal motions and presents oral arguments to Municipal, Superior, Court of Appeals, and Arizona Supreme Courts.
  • Advises law/code enforcement on new laws and legal challenges; trains staff; reviews legislation for impact on prosecution.
  • Participates in competency hearings; reviews mental health reports; files motions; advocates for victim safety.
  • Participates in regular assessment of case management processes and office procedures.
Qualifications and Requirements
  • Formal Education/Knowledge: Specialized knowledge in a professional/technical field; degree at Masters level or equivalent (e.g., J.D., professional certification); appropriate certification may be required.
  • Experience: Experience in Criminal Law is preferred.
  • Certifications and Other Requirements: Valid Driver’s License;
    Graduate of Law School;
    Licensed to practice law in Arizona.
  • Reading: Ability to read legal statutes, ordinances, and memorandums.
  • Math: Ability to perform general math calculations.
  • Writing: Ability to write legal motions, appeals, special actions, and advisory memorandums.
  • Managerial: Semi-Complex – occasional direction of helpers or interns.
  • Budget Responsibility: No budgetary responsibility.
  • Policy/Decision Making: Moderate – work guided by judgment with supervisory input as needed.
