The Texas Office of the Attorney General’s Medicaid Fraud Control Unit (MFCU) is seeking an experienced attorney to prosecute complex fraud cases and pursue justice for vulnerable Texans who are victims of abuse, neglect, and financial exploitation. This role offers the opportunity to handle significant financial crimes, protect public resources, and advocate for elderly and disabled victims.
Texas Medicaid spending exceeds $50 billion annually and accounts for approximately 40% of total state spending. National estimates suggest that up to 10% of health care spending may be lost to fraud. Cases frequently involve fraudulent billing schemes, billing for services not rendered, providing medically unnecessary services, illegal kickbacks, and identity misuse. Financial losses often reach seven figures or more, making these prosecutions both challenging and highly consequential.
The MFCU conducts investigations independently as well as in coordination with federal, state, and local law enforcement partners. This work protects critical health care resources and helps ensure that public funds remain available for those who depend on them.
This position is based in the Dallas MFCU Field Office. The Unit maintains nine regional field offices that provide statewide coverage across all 254 counties. The primary caseload for this position will arise from the DFW/North Texas region; however, the attorney may assist with prosecutions in other regions when needed. MFCU attorneys prosecute cases in partnership with locally elected district and county attorneys and are typically deputized to serve as lead counsel in assigned matters.
Travel, including occasional overnight travel, will be required and offers the opportunity to broaden courtroom experience by practicing in a variety of Texas jurisdictions.
Applicants should possess deep criminal prosecution experience and the ability to independently try complex cases as lead counsel. Applicants should be skilled at presenting cases to the grand jury, handling pretrial hearings, litigating evidentiary issues, negotiating plea agreements, and trying cases to a jury. The Unit seeks prosecutors who pursue cases with professionalism, tenacity, and an unwavering commitment to achieving justice.
Approximately 80–90% of cases involve health care fraud, while 10–20% involve patient abuse, neglect, or financial exploitation, often affecting elderly or disabled victims.
The position reports to the Deputy Chief of Prosecution in Austin and the Captain of the Dallas Field Office, while working closely with MFCU investigators and partner agencies.
Applicants should be prepared to complete an extensive law enforcement background investigation, including criminal history, employment, education, financial, reputation, and social media reviews.

MINIMUM QUALIFICATIONS:Assistant Attorney General (AAG) IV
- Education:
Graduation from an accredited law school with a J.D. - Licensed as an attorney by the State of Texas
- Member in good standing with the State Bar of Texas
- Experience:
Three years of full-time experience as a licensed attorney - Knowledge of laws and legal principles and practices relevant to the Medicaid Fraud Control Unit such as the U.S. Code, Federal Code of Criminal Procedure, Code of Federal Regulations.
