Position: Employee Benefits Attorney

Base Salary: $130,000 – $160,000 annually

Core Responsibilities
  • Structure and implement employee benefit plans in accordance with ERISA and Internal Revenue Code requirements
  • Advise on qualified retirement plans, including 401(k), defined benefit, and cash balance arrangements
  • Provide counsel on executive compensation and nonqualified deferred compensation plans (including Section 409A compliance, rabbi trusts, and incentive programs)
  • Guide clients on equity and alternative compensation vehicles such as ESOPs, phantom equity, stock options, profit‑sharing, and 457/403(b) plans
  • Advise on fiduciary obligations, governance frameworks, and risk mitigation strategies
  • Ensure compliance for health and welfare plans (ACA, HIPAA, COBRA, MHPAEA, ERISA)
  • Draft and review summary plan descriptions (SPDs), wrap documents, plan amendments, and employee communications
  • Support mergers and acquisitions through benefits due diligence and integration planning
  • Assist with IRS and DOL audits, investigations, and voluntary correction programs
  • Deliver strategic, business‑oriented advice to HR leadership, executives, and in‑house counsel
Qualifications
  • Juris Doctor (J.D.) from an accredited law school
  • Active admission to the Michigan Bar (or eligibility for admission)
  • 5+ years of focused experience in employee benefits law
  • Strong command of ERISA, qualified retirement plans, and executive compensation matters
  • Experience advising on fiduciary compliance and governance issues
  • Exceptional analytical, drafting, and communication skills
  • Ability to independently manage multiple client engagements
Preferred Experience
  • Health and welfare plan compliance advisory experience
  • Familiarity with DOL and IRS audit procedures and correction programs
