Duties SummaryThe function of the Securities Enforcement Branch (“SEB”) is to monitor and enforce the activities of entities not in compliance with the Uniform Securities Act, Chapter 485A Hawaii Revised Statutes (HRS) and the Franchise Investment Law, Chapter 482E (HRS), conducting a statewide program for the investigations and prosecutions of cases involving violations of securities and franchise laws. The Clerical Support Section provides legal and general clerical support services to the branch.
The primary purpose of this legal assistant position is to provide legal, administrative, technical, and secretarial support services to the attorneys in the SEB, who on behalf of the Commissioner of Securities (“Commissioner”), investigate complaints regarding potential securities law and franchise law violations, and if violations are found, institute legal action against registrants and unregistered individuals and entities under Chapters 485/485A and 482E of the Hawaii Revised Statutes, or any rule adopted or order issued thereunder, and other applicable authority.

General Experience
:
Four (4) years of paralegal work experience which demonstrates that the applicant possesses knowledge of interviewing techniques; rules of evidence; the legal system and procedures; legal research methods and sources of legal information; and that the applicant also has the ability to understand and explain legal processes and procedures; evaluates and analyze facts and legal issues; prepare legal reports, documents and correspondence;
speak clearly, and follow oral and written instructions.
Knowledge
:
Interviewing techniques; rules of evidence; legal system and procedures; legal research methods and sources of legal information.
Skills/Abilities
:
Understand the legal terminology, processes and procedures; recognize and avoid potential problems in the unauthorized practice of law; read and understand laws, statutes, rules and legal documents; evaluate and analyze facts and legal issues; prepare legal reports, documents and correspondence; follow oral and written instructions; and communicate and deal tactfully and effectively with others.
Applicants must be citizens, permanent resident aliens, or nationals of the United States. Non-citizens with unrestricted employment authorization from the U.S. Immigration and Naturalization Service may also apply.
Other InformationThis position is exempt from the civil service and considered temporary in nature.
