Overview
The primary purpose of this position is to research consumer bankruptcy cases filed in the Eastern District of Texas (Beaumont & Lufkin Divisions) and review bankruptcy schedules & statements for outstanding taxes. The clerk will input data and update coding into Bank Tool and Tax Tool. The clerk will prepare and e-file Notices of Appearance and Proofs of Claims as needed.
The clerk will also monitor checks from all bankruptcy cases and prepare a memo of instructions for clients on how to post payments. If a bankruptcy case becomes delinquent in plan payments, the clerk will prepare a letter of Plan Default. This will require the ability to read and understand bankruptcy plans, and orders, and calculate interest amounts to determine whether there is a default.
Defaults in business cases will be coordinated with the Business Bankruptcy Team. If the default isn t cured timely, then the Clerk will prepare a Notice of Plan Default to be filed with the Court.
Monitor payments received from all bankruptcy cases. Review the check, Bank Tool, bankruptcy plans, and confirmation orders to determine how the payment should be applied. Draft memos of instructions to clients on how to post the payments. Coordinate with the Business Bankruptcy Team (Business Paralegal, BK Manager, Attorneys). By reviewing Bank Tool, bankruptcy plans, and confirmation orders, confirm defaults by coordinating with the Business Bankruptcy Team.
