The Work You Will Do:

The senior attorney position is responsible for litigation of enforcement actions related to Alcoholic Beverages and Tobacco regulation. This position is directly supervised by the Deputy Chief Attorney with direction and guidance from the Chief Attorney for the Alcoholic Beverages and Tobacco Legal Unit .

Your Specific Responsibilities:

* Provides training and guidance to attorneys, OPS personnel within the Alcoholic Beverages and Tobacco Legal Unit;

* Litigates enforcement actions;

* Evaluates investigative reports and evidence;

* Drafts and issues subpoenas;

* Negotiates settlements;

* Drafts pleadings, complaints, motions, notices, and orders;

* Compiles exhibits;

* Witness preparation;

* Takes and defends depositions;

* Initiates and responds to discovery;

* Prosecutes and defends enforcement cases and rule challenges before the Division of Administrative Hearings;

* Prosecutes and defends final orders, emergency suspension orders, declaratory statements, rule waivers, and various cases in circuit courts;

* Files and answers foreclosure cases;

* Files claims and intervenes in bankruptcy proceedings and federal actions as requested by the Division of Alcoholic Beverages and Tobacco;

* Drafts, reviews, edits, and evaluates proposed rule packages;

* Responds to Joint Administrative Procedures Committee correspondence;

* Implements agency policy;

* Responds to consumer inquiries in writing and verbally.

* Ability to draft legal documents;

Preference:
Knowledge of Chapters 120, 210, 561-565 Florida Statutes.

Minimum Requirements:

* Membership in good standing with The Florida Bar; and

* At least two years of experience in the practice of law; and

* Valid Driver's License.
