PATRIICK DANIEL LAW is a nationally recognized boutique plaintiff’s personal injury firm headquartered in Houston, Texas, seeking a motivated and talented Bad Faith Insurance Litigation Attorney to join our trial team. This is a unique opportunity to build and manage a dedicated bad faith insurance docket within a firm that has an established track record of taking on the nation’s largest corporations and insurers—and winning.

Key Responsibilities
  • Investigate, evaluate, and prosecute first-party and third-party bad faith insurance claims on behalf of policyholders from inception through trial and appeal.
  • Identify and develop bad faith insurance components embedded within the firm’s existing catastrophic personal injury, products liability, and trucking litigation docket.
  • Conduct in-depth analysis of insurance policies, coverage disputes, claims handling practices, and insurer conduct to build compelling bad faith cases.
  • Draft and argue complex motions, pleadings, discovery requests, depositions, pre‑trial memoranda, and appellate briefs in state and federal courts nationwide.
  • Take and defend depositions of corporate representatives, claims adjusters, underwriters, and expert witnesses.
  • Develop and execute litigation strategy, including extra‑contractual and statutory bad faith theories, Stowers demands (Texas), and analogous frameworks in other jurisdictions.
  • Pursue all available remedies including policy benefits, consequential damages, statutory penalties, punitive damages, and attorney’s fees.
  • Collaborate closely with the firm’s personal injury trial team to maximize client recovery by layering bad faith claims onto underlying tort cases.
  • Stay current on developments in insurance bad faith law, regulatory changes, and emerging trends across multiple jurisdictions.
  • Maintain direct, compassionate communication with clients and uphold the firm’s “Dan Fam” standard of client care.
Qualifications Required
  • Juris Doctor from an ABA‑accredited law school.
  • Active bar license in good standing in Texas (additional state licensure a significant plus; the firm is also licensed in Louisiana and Wisconsin).
  • Minimum 3 years of civil litigation experience with meaningful exposure to insurance coverage, bad faith, or insurance defense matters.
  • Demonstrated ability to manage a litigation caseload independently from intake through trial.
  • Strong legal research, writing, and oral advocacy skills.
  • Federal court experience, including familiarity with removal, multi-district litigation (MDL), and federal procedural rules.
  • A passion for plaintiff’s advocacy and a commitment to holding insurers accountable.
  • Prior experience representing plaintiffs or policyholders in bad faith insurance litigation.
  • Working knowledge of the Texas Insurance Code (Chapters 541 and 542), Stowers Doctrine, ERISA preemption issues, and analogous bad faith statutes in other states.
  • Experience with catastrophic injury cases, products liability, trucking litigation, or maritime law.
  • Deposit and trial experience (first‑chair preferred).
  • Existing relationships with bad faith insurance experts, public adjusters, or policyholder advocacy organizations.
  • Admission or willingness to seek admission in multiple state and federal jurisdictions.
Compensation & Benefits
  • Base Salary: $115,000 annually.
  • Performance Bonus:
    Percentage of recovery from the attorney’s assigned docket.
