General Summary

Manages Liability Claims Department for Dallas Area Rapid Transit's (DART) Risk Management Division. Responsible for all Risk Management Open Records Requests. Develops and monitors section budget. Supervises 7 employees and oversees contracts totaling approximately $100,000.

Responsibilities
  • Manages personnel involved in activities related to liability claims. Interviews, selects, develops, trains, evaluates, and if necessary, recommends termination of subordinate personnel according to established policies, procedures, and guidelines to include EEO and affirmative action.
  • Reviews all accident/incident reports for the entire agency (Bus, Rail, NRV); assigns claim numbers, orders police reports, and determines files for subrogation on each.
  • Assigns claims to adjusters and oversees investigation to ensure liability has been properly determined, procedures have been followed, timely and equitable settlements have been made within established limits of authority.
  • Performs quarterly review of current lawsuits with proper DART attorney and oversees the defense/settlement of lawsuit.
  • Conducts quarterly audit of all claim files with handling adjuster and makes recommendations on how to proceed towards settlement.
  • Reviews files and authorizes settlements up to $15,000.00.
  • Negotiates and makes disposition of claims within established limits of authority.
  • Assists staff in determining liability on individual claims and directs line of negotiation with claimant or their attorney.
  • Investigates and prepares response on complaints for President/Executive Office and Customer Service.
  • Coordinates with DART's Legal Department concerning lawsuits; attends depositions, mediations and trials as necessary.
  • Performs other related duties as assigned.
Qualifications
  • Bachelor’s degree from an accredited college or university in Business Administration, Finance, or related field.
  • Six (6) years progressively more responsible liability claims experience, including a minimum of three (3) years experience supervising a liability claims adjustment staff.
  • Must have a Casualty License required by the State of Texas.
  • Must have proficiency with camera, tape recorder, beeper, mobile phone, and investigative equipment and tools.
  • Valid Texas A, B, or C driver’s license with no driving‑while‑intoxicated conviction within the last sixty (60) consecutive months, not more than one DWI on driving record, and not more than three convictions of moving violations within the last thirty‑six (36) consecutive months in order to operate DART non‑revenue vehicles.
  • Passes a Department of Transportation (Use the "Apply for this Job" box below). (medical) examination, which includes a drug screen in order to operate DART non‑revenue vehicles.
  • Analytical, creative, and problem‑solving skills to address complex interpersonal, technical, and administrative situations.
  • Strong communication and negotiation abilities, with the capacity to write clearly and to work effectively with internal and external customers.
  • Ability to manage multiple tasks, set objectives, develop schedules, anticipate and mitigate roadblocks, and evaluate performance against goals.
Working Conditions

Works in an environment where there is minimum exposure to dust, noise, or temperature. May be moderately exposed to unpleasant working conditions to include dust, noise, temperature, weather, petroleum products, and chemicals while visiting DART's operating facilities, assuming the incumbent observes all policies and procedures, safety precautions and regulations, and uses all protective clothing and devices provided.
