Job Description and DutiesELS deputies may largely choose to telework or come into the office at their option. In this litigation-focused role, deputies will handle challenges involving the Fair Employment and Housing Act, Title VII, Americans with Disabilities Act, Family and Medical Leave Act, California Family Rights Act, and the Whistle blower Protection Act, among others.
Deputy Duties (Responsibilities)- Independently handle all aspects of complex civil employment cases, including drafting and arguing motions, interviewing witnesses, conducting and defending depositions and other discovery, preparing and arguing summary judgment motions, expert discovery, and preparing for trial.
- Handle jury and bench trials.
- Handle contested administrative evidentiary hearings before the State Personnel Board.
- Defend agency administrative actions against petitions for writs of mandamus.
- Draft appellate briefs and argue before the Courts of Appeal and Ninth Circuit.
- Obtain work safety and gun violence restraining orders.
- Communicate with clients, providing detailed case analyses and recommendations.
- Provide training, guidance, and advice to state agencies on a variety of employment and personnel matters.
- Communicate with judges, court staff, juries, and witnesses.
- Work cooperatively, professionally, and effectively with colleagues, opposing counsel, and clients.
- Must reside in California and be an active member in good standing of the California State Bar.
- New to State candidates will be hired at the minimum salary of the classification.
- Meet all minimum qualifications stated in the Class Specification.
- Civil litigation experience in California state or federal courts.
- Excellent legal research skills.
- Experience drafting and arguing pre‑trial motions, including demurrers, motions to dismiss, and motions for summary judgment.
- Effective written advocacy skills in preparing briefs, presenting testimony, and advocating at hearings before administrative bodies, trial courts, and appellate courts.
- Ability to interview witnesses and examine percipient and expert witnesses at depositions, hearings, and trials.
- Ability to clearly and respectfully advise and communicate with clients, colleagues, and court personnel.
- Openness to collaboration, including receiving feedback from colleagues, supervisors, and clients on case strategy and written work product.
- Experience presenting testimony, and advocating at hearings before administrative bodies, trial courts, and appellate courts.
- Employment litigation experience is a plus, but not required.
