Job Summary

The Associate General Counsel Student Affairs position will focus on issues related to student and academic affairs, including student conduct, academic misconduct and discipline, sexual misconduct, harassment and violence, student residency, student speech, student privacy, student health and wellbeing issues, student athletes and Name, Image, and Likeness (NIL) licensing agreements, disability issues relating to students, student travel, and international student-related issues.

Provides a high level of professional legal services to Student Affairs matters. Provides legal support to the FIU Police Department, including assisting on the bargaining team. Advises university officials on legal aspects of policy, assists in formulation of policy. Interacts with members of the University community that includes faculty members, staff and with administrators on the departmental, college, vice presidential and presidential level.

• Provides a high level of professional legal services to the University. Manages general legal matters, advises University officials on legal aspects of policy, assists in formulation of policy, and interacts with members of the University community, legal profession, officials of state and federal government and others as assigned by the General Counsel.

• Advises University executives in policy-making functions. Interprets policy for University officials up to and including presidential level.

• Conducts legal research and renders interpretative memorandum as needed.

• Maintains frequent and continuing contact with members of the public and private legal profession, the judiciary and various administrative agencies, both on a state and federal level.

• Conducts regulation making for the University, and handles regulatory issues and compliance, in the areas of student and academic affairs, open meetings, and public records.

• Advises on all matters relating to student and academic affairs, including student conduct and academic integrity, sexual misconduct, harassment and violence, student residency, student speech and expression, student privacy, student health and well-being issues, student athletes and licensing agreements, student disability issues, student travel, international student-related issues, tuition waivers, and financial aid and tuition, overseeing any litigation relating to such matters.

• Assists in the development of policies, advises University officials in policy making functions, and interprets policies for University officials (up to and including presidential level), in the areas of student and academic affairs and Florida Sunshine Law requirements (e.g., open meetings and public records).

• Serves as backup to the University Counsel/HR, assists, as needed, with employment-related matters (both for faculty and staff), including providing legal advice regarding promotions, discipline, collective bargaining, grievances, etc. Assists with other faculty-related matters, including faculty governance, immigration, academic freedom, and accreditation.

• Supports the FIU Police Department in legal affairs. Assists the bargaining team for the FIU/PBA Collective bargaining agreement.
