The Work You Will DoThe senior attorney position is responsible for litigation of enforcement actions related to Alcoholic Beverages and Tobacco regulation. This position is directly supervised by the Deputy Chief Attorney with direction and guidance from the Chief Attorney for the Alcoholic Beverages and Tobacco Legal Unit.
Your Specific Responsibilities- Provides training and guidance to attorneys and OPS personnel within the Alcoholic Beverages and Tobacco Legal Unit
- Litigates enforcement actions
- Evaluates investigative reports and evidence
- Drafts and issues subpoenas
- Negotiates settlements
- Drafts pleadings, complaints, motions, notices, and orders
- Compiles exhibits
- Witness preparation
- Takes and defends depositions
- Initiates and responds to discovery
- Prosecutes and defends enforcement cases and rule challenges before the Division of Administrative Hearings
- Prosecutes and defends final orders, emergency suspension orders, declaratory statements, rule waivers, and various cases in circuit courts
- Files and answers foreclosure cases
- Files claims and intervenes in bankruptcy proceedings and federal actions as requested by the Division of Alcoholic Beverages and Tobacco
- Drafts, reviews, edits, and evaluates proposed rule packages
- Responds to Joint Administrative Procedures Committee correspondence
- Implements agency policy
- Responds to consumer inquiries in writing and verbally
- Ability to make oral presentations and litigate
- Ability to communicate points of law and regulatory policy persuasively and concisely
- Ability to draft legal documents
- Ability to manage multiple legal cases
- Ability to work independently and in group and team settings
- Ability to utilize problem solving techniques
- Ability to establish and maintain effective working relationships
- Ability to multi-task
- Ability to meet competing deadlines
Ability to plan, organize and coordinate work assignments - Ability to travel
- Ability to recognize and act on emerging issues and shifting priorities
Preference:
Knowledge of Chapters 120, 210, 561-565 Florida Statutes.
- Membership in good standing with The Florida Bar
- At least two years of experience in the practice of law
- Valid Driver's License
- State of Florida retirement package: 3% employee contribution required
