The Advisor, Employment Practices role is dynamic and diverse in scope to support Arch Well Health's objective to be a best place to work. The role encompasses a mix of non-litigation and litigation support, including EEOC matters, provider Employment Agreement development and Colleague Handbook ownership. The role reports to the CHRO with a dotted line to in-house counsel.
Non-Litigation Support- Prepare and review provider employment contracts and amendments, restrictive covenant agreements, severance packages, retention agreements, and separation agreements.
- Create and maintain “clause library” of provider contract language changes as approved by legal counsel.
- Provide guidance to HRBPs and leaders on corrective action, workplace investigations, and compliance with federal/state employment laws, including training on best practices and legal risk mitigation.
- Conduct research and partner with legal counsel, talent acquisition, payroll and HRBPs to ensure state-specific requirements are met throughout the employment process, including onboarding and offboarding documents and processes
- Advise on disciplinary action recommendations, providing support and guidance on employee relations matters, ensuring compliance with policies and employment law.
- Lead the design of investigation processes to improve consistency, effectiveness, and timeliness across all regions.
- Proactively identify and diagnose systemic workforce trends. Develop and deploy targeted, preventative measures and interventions to reduce overall grievances and address root-cause issues.
- Assist with the preparation and filing of documents required by federal, state, and local employment laws and in response to requests from external counsel regarding employment matters
- Spearhead critical collaboration across internal stakeholders, including HRBPs, Compliance, and Legal Counsel to synthesize investigation findings into actionable recommendations, effectively mitigating organizational risk and exposure.
- Collaborate on the development of workplace policies and training programs, and maintain Colleague Handbook and workplace policy updates
- Partner with compliance to review and approve submitted Conflicts of Interest and required admonishments
- Maintain standards, review flags, and disposition candidate background checks and required colleague monitoring in alignment with legal and Compliance standards
- Serve as the primary point of contact for EEOC charges and investigations; assist attorneys during EEOC mediation and conciliation
- Investigate discrimination claims under Title VII, ADA, ADEA, and other federal statutes
- Coordinate with HRBPs to gather and organize evidence to prepare position statements and responses to EEOC charges
- Partner with counsel to draft and conduct legal analysis on EEOC position statements, agency responses, and demand letter replies, ensuring defensible and consistent arguments across all cases.
- Provide comprehensive litigation support and investigation management for a multi-state medical group, serving as a key partner to in-house counsel, HR, Compliance, outside counsel, and our EPLI carrier.
- Manage discovery and fact-finding for employmentlawcases (discrimination, harassment, ADA/FMLA, retaliation), while collaborating with outside counsel on litigation strategy and case resolution when disputes elevate.
