Educational Expert Witness Consultant – Special Education

Location: New York City, NY

Position Type: Part-Time / Independent Consultant

Work Arrangement: Primarily Remote;
In-Person Attendance as Required

Position Overview

We are seeking a highly qualified and experienced Educational Expert Witness Consultant to provide professional consultation, case review, analysis, and expert testimony in matters involving special education students in New York City.

The Expert Witness Consultant will review educational records and provide independent professional opinions regarding a student's educational needs, special education programming, services, evaluations, placement, and related educational matters. The consultant may support cases involving IEPs, special education services, due process proceedings, impartial hearings, and other educational disputes
.

This position is primarily remote
; however, in-person participation may be required on a case-by-case basis for student observations, meetings, hearings, testimony, or other case-related activities.

This is a part-time independent consultant position and does not include health insurance or employee benefits
.

Responsibilities
  • Conduct comprehensive reviews of student educational records, including IEPs, evaluations, progress reports, academic records, assessments, service records, prior written notices, and other relevant documentation.
  • Analyze students' educational needs, programming, services, accommodations, modifications, goals, and placement.
  • Evaluate whether proposed or implemented educational programs appropriately address the student's identified needs.
  • Review educational evaluations and other professional assessments relevant to the case.
  • Provide objective, professional opinions based on the consultant's expertise, review of the record, and other appropriate case information.
  • Prepare written expert reports, summaries, recommendations, declarations, affidavits, or other case-related documentation when requested.
  • Participate in case consultations and strategy meetings with attorneys, educational advocates, parents, and other professionals.
  • Conduct student or program observations when appropriate and authorized.
  • Provide expert testimony during impartial hearings, depositions, administrative proceedings, or other legal proceedings when requested.
  • Clearly explain educational terminology, special education practices, IEP components, student needs, and professional recommendations during testimony.
  • Review opposing expert reports or other educational evidence when requested and provide professional analysis.
  • Maintain thorough records regarding case review, consultation, preparation, and testimony.
  • Maintain confidentiality of student, family, educational, and legal information.
  • Remain objective and independent when forming and presenting professional opinions.
Areas of Expertise

Candidates should possess substantial knowledge and professional experience in areas such as special education programming, IEP development and implementation, evaluations and assessments, academic interventions, accommodations and modifications, related services, student progress monitoring, educational placement, and services for students with disabilities.

Familiarity with IDEA, New York special education procedures, NYC Public Schools, and special education due process/impartial hearing matters is strongly preferred.

Qualifications
  • Advanced degree in Special Education, Education, Educational Leadership, or another relevant discipline preferred.
  • Appropriate professional certification, licensure, credentials, and/or demonstrated expertise within the individual's professional discipline.
  • Significant professional experience working in special education.
