Position Summary:

Under the supervision of the Associate Counsel, Commercial Unit, with wide latitude for independent judgment and unreviewed action and decision, performs contract‑related legal work. This includes negotiating contract terms, addressing matters of contract compliance and researching applicable laws, rules, and regulations. Performs related work.

Key Relationships: OGC’s Executive Directors and Attorneys, NYC Law Department Attorneys, the Division and Contracts and Purchasing and Programmatic Stakeholders.

Responsibilities
  • Negotiates the terms of and drafts procurement and contract documents involving various New York City Public Schools (NYCPS) professional and related services solicitations, ensuring conformity with all applicable laws, rules, and regulations.
  • Resolves legal issues relating to NYCPS contract terms and related policies and procedures.
  • Advises on legal issues related to the NYCPS’s published Procurement Policy and Procedures.
  • Analyzes and prepares legal opinions on issues regarding various City, State, and Federal regulations.
  • Drafts and reviews proposed policies, rules, and regulations.
  • Supervises subordinate attorneys and staff; reviews, revises, and approves agreements and other documents prepared by subordinate attorneys.
  • Guides and reviews the work of subordinates for accuracy and to ensure compliance with agency policy and applicable laws.
  • Implements working knowledge of procurement rules and procedures and exercises familiarity with education‑related environmental issues.
  • Reviews contracts to determine vendor compliance with terms and conditions.
  • Negotiates with vendors regarding resolution of complex compliance matters.
  • Recommends resolution of complex contract compliance matters, including corrective actions or termination.
Qualification Requirements Minimum
  • Admission to the New York State Bar; and either 2 or 3 below.
  • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
  • Six months of satisfactory service as an Agency Attorney Intern (30086).

Note:

In addition to meeting the minimum qualification requirements, candidates must have two (2) years of experience as an attorney in a New York City government agency; and/or three (3) years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.

Incumbents must remain Member of the New York State Bar in good standing for the duration of this employment.

  • Superior organizational skills and attention to detail.
Salary

$130,680 - $140,760 (Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
