Location: New York

The Kings County District Attorney’s Office (the “Office”) is seeking an experienced and motivated attorney to join its Civil Litigation Unit and FOIL Unit. Like any large public institution, the Office is regularly involved in civil lawsuits and civil litigation-related matters that require the skill and judgment of a dedicated in-house litigation team. In addition, the Office responds to a high volume of subpoenas and Freedom of Information Law (“FOIL”) requests, many of which result in contested litigation.

This position offers a unique opportunity for attorneys to expand their litigation experience and gain meaningful exposure to New York State and federal civil litigation. Attorneys assigned to these Units play a critical role in protecting the Office’s legal interests while ensuring compliance with transparency and disclosure obligations.

Responsibilities

Attorneys in this role will gain hands-on experience in a wide range of civil litigation and advisory matters, including:

  • Representing the Office in state and federal civil litigation
  • Coordinating with the New York City Law Department on civil actions filed against the Office
  • Responding to and frequently litigating subpoenas and FOIL requests served on the Office
  • Preparing and defending witnesses for civil depositions
  • Negotiating and drafting civil contracts entered into by the Office (including complex commercial contracts)
  • Negotiating and drafting civil settlement agreements
  • Representing assistant district attorneys before the Second Department’s Attorney Ethics Committee
  • Representing the Office and its employees before the Equal Employment Opportunity (“EEO”) Commission and the New York State Division of Human Rights
  • Representing the Office in administrative hearings, including, but not limited to, hearings pursuant to Section 75 of the New York State Civil Service Law
  • Advising the District Attorney, and his executive staff, on employment law and other internal civil legal matters
Qualified candidates must demonstrate the following
  • A minimum of three (3) years of experience as a practicing attorney
  • Strong legal research and writing skills
  • Experience making legal arguments in court
  • A positive, collaborative attitude and willingness to learn new practice areas
  • Reliability and the ability to work effectively as part of a team
