AGREEMENT BETWEEN A SCHOOL AND A TEACHER

This agreement is made on this ______ day of ________, 20, between ____________________ School, situated at ____________________________________, represented by its President/Secretary, etc. (hereinafter referred to as the "School") of the One Part, and Shri ____________________, S/o ____________________, resident of ____________________________________ (hereinafter called the "Teacher") of the Other Part.

It is hereby agreed as follows:

In consideration of the effective service offered by the teacher as a qualified teacher, the school hereby employs the teacher to instruct the pupils of the school in such subjects as the school may from time to time prescribe (or state the subjects), and to take such part in the internal organisation and discipline of the school as it may from time to time direct.

The school shall pay the teacher, during the term of this agreement, a basic salary of Rs. ____________ per year (or a salary beginning at the rate of Rs. ____________ per year, with annual increments of Rs. ____________ per year, subject to a maximum salary of Rs. ____________ per year). Such salary shall be paid in equated instalments at the end of the month for which it is due, or before the 7th of the following month.

The teacher shall also receive such other payments — e.g. gratuity, dearness allowance, etc. — as may be laid down by the rules, and in the absence thereof, by the rules prevailing in Government institutions in that behalf, unless otherwise provided, payable together with his salary as stated above.

The teacher shall maintain strict discipline, attend classes punctually and regularly, and teach such lessons as allotted to him by the Secretary/Headmaster from time to time throughout school hours, and shall also attend such tutorial and special coaching classes as may be allotted to him, even after school hours.

The teacher shall observe the rules and regulations of the University/Board of Secondary Education, and shall comply with all decisions of the Managing Committee, Headmaster and Secretary as may be given or laid down from time to time.

Apart from the duties of teaching, organisation and discipline, the teacher shall, when required to do so, supervise and instruct the regular games and pastimes of the pupils and be present at religious services and social functions in the school among the pupils.

The teacher shall use his best efforts to instil discipline, good habits and good morals among the students and to develop their character. The teacher shall not administer any corporal or physical punishment to any pupil, such punishment being prohibited by law.

The teacher shall be entitled to such leave as is laid down in the rules of the school, or as observed in Government schools.

Clauses 2 and 8, concerning increments and leave, shall become operative upon confirmation of service after completion of one full educational session (one year), subject to the teacher giving satisfactory service and fulfilling the terms of this agreement.

The teacher shall not give private tuition to any student of this or any other school, nor carry on any trade, business or profession, nor have any interest in any other educational institution, unless permitted in writing by the school, and shall not engage in any activity prejudicial to the interests of the school or the Managing Committee.

This agreement may be terminated at the end of a school term by either party serving on the other written notice to that effect, given at least two weeks after the commencement of such term; or at any time by the school, on paying the teacher — in addition to the proportionate salary due up to the date of such termination — one-third (or, etc.)

of the said annual salary. Provided that in cases of gross misconduct, neglect of duty, or contravention of any of the terms of this agreement (notwithstanding any waiver or condonation thereof), the school may terminate this agreement at once, without notice or compensation in lieu of notice, on paying the teacher the part of salary due up to the date of termination.
