Job Description
Join Allstate's legal frontline and play a critical role in recovering losses and advancing strategic litigation outcomes. As a Senior Subrogation Attorney, you will lead complex auto and property subrogation matters from investigation through resolution, while providing legal guidance to claims partners and business stakeholders.
This role offers the opportunity to independently manage sophisticated litigation, develop recovery strategies, conduct negotiations, and represent Allstate in court, arbitration, mediation, and trial proceedings. You will collaborate closely with legal and claims teams, provide thought leadership on subrogation matters, and contribute to meaningful financial and operational impact through successful recovery efforts.
This remote‑based position requires occasional in‑person attendance for court appearances throughout New Jersey, as needed, and participation in monthly or quarterly team events at our Clark, NJ office.
Key Responsibilities- Manage all aspects of complex auto and property subrogation litigation from investigation through resolution, including discovery, depositions, motion practice, negotiations, arbitrations, trials, and post‑trial motions.
- Investigate and evaluate subrogation opportunities, determine liability and damages, and develop recovery strategies to maximize results.
- Lead negotiations with carriers, attorneys, and third parties to achieve favorable recovery outcomes and efficient dispute resolution.
- Review new file assignments, develop litigation strategies, and provide legal guidance aligned with business objectives.
- Partner with claims professionals and business stakeholders to provide legal counsel on litigation risks, recovery opportunities, and case strategy.
- Prepare and present witnesses, conduct depositions, and represent the Company in hearings, mediations, arbitrations, and trials.
- Analyze claims files, expert reports, legal authorities, and other case materials to support litigation strategy and recovery recommendations.
- Prepare and argue pre‑trial and post‑trial motions, settlement proceedings, and other complex legal matters.
- Monitor developments in applicable laws, regulations, and case law, providing proactive guidance on potential impacts to subrogation recoveries and litigation strategy.
- Manage a high‑volume caseload and legal projects effectively while collaborating with attorneys, claims teams, and support staff to drive successful outcomes.
- Juris Doctorate required.
- Active membership in good standing with the New Jersey State Bar required.
- 4+ years of litigation experience, including insurance defense, subrogation, personal injury, property damage litigation, or related practice areas.
- Demonstrated ability to independently manage a substantial litigation caseload from inception through resolution.
- Experience conducting depositions, mediations, arbitrations, hearings, and other litigation proceedings.
- Strong knowledge of civil litigation procedures, legal strategy development, negotiation, and dispute resolution.
- Proficiency in Microsoft Office, Lexis Nexis (preferred), and legal research platforms.
- Ability to collaborate effectively with attorneys, paralegals, claims professionals, and support staff.
