This is a Full-Time 40 Hour Weekly position with the Bureau of Human Resources and Administration ('BHRA'), recently formed by merger of the former Bureau of Human Resources and former Bureau of Administration. The Office of General Counsel, Bureau of Human Resources and Administration, seeks to fill the position of Assistant General Counsel focused on performing transactional legal work encompassing the following areas: employment law, public procurement law, and administrative law. The position filled will have an emphasis on employment law and report to the General Counsel for the Bureau of Human Resources and Administration.

Duties

Primary duties will include advice and counsel related to one or more of the following legal portfolio areas: employment law, public procurement law, and administrative law. Employment law duties include advice and counsel regarding hiring actions, adverse personnel actions, appeals and grievances, conflicts of interest, immigration compliance, workers compensation, Family and Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), subrogation claims, and subpoena response.

Public procurement duties include advice and counsel regarding the formation and administration of service and supply contracts, information technology contracts, professional services contracts, public improvement contracts, and leases. Administrative law duties include advice and counsel regarding risk management, federal and state surplus property sales, fleet and travel management, debt recovery, open records requests, and records management. Additional duties may include, but are not limited to, litigation support, advice on administrative rule making and/or legislative bill drafting, and other legal services and special projects on an as‑needed basis.

Level assignment, payrate, and classification will depend on the experience and qualifications of the applicant. Duties in the higher classification(s) will be similar; however, project complexity and oversight may change.

Licenses and Certifications

Current admission to practice with the State Bar of South Dakota or ability to obtain admission within six months of start date.

A strong work ethic, integrity, initiative, and an interest in transactional legal work related to one or more of the following legal portfolio areas: employment law, public contracting, and the administrative functions and responsibilities of state government.
