ABOUT THE DEPARTMENT
The County Counsel provides most of the civil legal services required by the County. The County Counsel represents the County and its officers and employees in civil actions. The office drafts or reviews for legal sufficiency all proposed legislation, contracts, leases, deeds, ordinances, and resolutions. Statutory interpretation and the issuance of legal opinions in response to requests from County officials comprise another major area of responsibility.

The County Counsel also identifies and explains legal trends to assist in program planning.
ABOUT THE POSITION
Extra help positions are hourly employees that may work up to 900 hours in a fiscal year (July 1-June 30). Benefits are not included.
Under direction of a licensed attorney, perform legal research, prepare motions, appear in court on matters on calendar, perform clerical and investigative duties as assigned in one of the County's legal departments; and perform related legal work as assigned
DISTINGUISHING CHARACTERISTICS
This classification is an unclassified, at-will, Extra Help classification. Extra help positions are limited in that they may work up to 900 hours in a fiscal year (July 1-June 30). Benefits are not included. The number of hours worked per week may vary and depend on the needs of the department.

The Law Clerk - Confidential position is distinguished from the Paralegal, Legal Secretary and other legal classifications in that it is designed to be filled by individuals who are eligible for certification as a registered law student as defined by the board of Trustees of the State Bar and/or are awaiting bar exam results. The position will provide direct exposure to courtroom proceedings, client advocacy, trial preparation, and will prepare legal documents and research under the mentorship of experienced attorneys.

This is a Confidential classification. Confidential in this context according to the Personnel Rules means "a non-management employee who, in the course of his or her duties, is regularly privy to management planning or decision making regarding the County's administration of employer-employee relations as determined by the Board of Supervisors."

EXAMPLES OF ESSENTIAL DUTIES
Duties may include, but are not limited to, the following:
Performs legal research and assists with the preparation of trial briefs and legal memoranda by collecting data on legal precedents and statutory authority applicable to current cases; prepares motions and pleadings; reviews case files, organizes reports, prepares witness lists, and prepares summary sheets for reports and evidence; summarizes records, depositions, background information, and other legal documents regarding contacts with witnesses, victims, experts, clients and third parties for use by attorneys and for file documentation;

conducts client and witness interviews; drafts ordinances, resolutions, and other legal measures and submits to a supervising attorney for review and discussion as appropriate; creates and maintains documents related to cases and other legal matters, trial notebooks, indices, and files; assists attorneys with trial preparation including, but not limited to, drafting jury instructions, witness and exhibit lists, expert witness disclosure demands and responses, prepares subpoenas, conducts privilege reviews, and assists at depositions, hearings, and trials, and document reviews;

reviews complaints and law enforcement agency reports or records; confers regularly with investigators regarding the collection of facts; monitors legal developments, including proposed legislation and court decisions and recommends appropriate course of action; prepares preliminary analysis of legislative bills and researches legislative history; responds to California Public Record Act requests; conducts hearings and trials in court, under supervision of a licensed attorney, as a certified law clerk as allowed by the California State Bar;

performs other duties as assigned.
