The State of New Hampshire, Department of Education, Division of Educator Support and Higher Education & Office of Misconduct has a full-time vacancy for a Misconduct Attorney.
SummaryTo administer and oversee all legal and operational activities, including compliance with applicable statutes and administrative rules, on matters related to educator misconduct, student safety, including restraint and seclusion, higher education, and other related matters.

Other information MINIMUM QUALIFICATIONS Education/ExperienceEquivalent combination of 12.5 years of education and experience after completion of high school. Must include at least 5.5 years of experience in the active practice of law.
License/CertificationValid driver’s license or access to transportation for use in statewide travel.
Other RequirementsMust be an active member of the New Hampshire Bar Association and in Good Standing.

When applicable, the work of an employee in trainee status in this position shall be overseen by a fully qualified individual. An employee in trainee status shall meet the minimum qualifications within the period of time specified on the SJD, not to exceed one year of being hired into this position.
Responsibilities- Administers, oversees, and coordinates investigations for complaints filed with the Department of Education that allege educator misconduct has occurred, to include licensure breaches and student safety concerns such as restraint and seclusion, in preparation for hearings with the NH Board of Education.
- Analyzes the sufficiency of evidence developed in particular investigations and collaborates with investigators to determine appropriate course of action, directing the gathering of additional case data, evidence, or information to ensure fulfillment of the Department objectives and desired outcomes.
- Directs the adjudication and resolution of complaints and hearings related to educator misconduct and student safety, including restraint and seclusion, to ensure all are conducted in a timely and legally compliant manner in accordance with applicable statutes, administrative rules, and Department policies. Coordinates with relevant Department staff to ensure accurate documentation, tracking, and reporting of disciplinary actions.
- Manages and evaluates the work performance of investigators, including providing training, identifying appropriate assignments, and performing disciplinary action to ensure effective and consistent case management.
- Interprets applicable state and federal rules and regulations and related law to provide in-depth legal analysis, to assist in the evaluation and oversight of legal strategies, and to provide legal guidance to the Department regarding matters of educator misconduct and student safety.
- Administers programs related to student safety, including restraint and seclusion, ensuring compliance with statutory and regulatory requirements. Manages program operations, including oversight of contracts, budgets, and procurement activities related to hearings, investigations, and other related services.
- Oversees the drafting of program manuals, technical advisories, and program policies and procedures; develops and supports data collection and reporting processes; and provides training related to educator misconduct and student safety.
- Monitors compliance with administrative decisions and implements corrective actions as necessary within the educator misconduct and student safety programs.
- Coordinates with other divisions, state agencies, and stakeholders to ensure consistent application of laws, rules, and policies related to educator misconduct and student safety.
