Job Description and Duties
Under the general supervision of the Senior Assistant Attorney General (SAAG), the Chief Assistant Attorney General, the Chief Deputy Attorney General, and the Attorney General, the Supervising Deputy Attorney General (SDAG) of the Correctional Law Section's appeals team provides proactive, organized, detail-oriented, hands-on leadership, supervision, direction, training, and mentorship to a team of legal professional that includes Deputy Attorneys General (DAGs) and may include paralegals and support staff.
As the head of the Section's appeals team, the SDAG performs and oversees the Section's most difficult appellate work, including complex class-action appeals, which requires a high level of independent judgment and the ability to work collaboratively with clients and the Office of the Solicitor General to develop and implement appellate strategy. Because the SDAG regularly oversees work at the highest appellate courts and may personally handle the most complex and sensitive matters, they should be familiar with Supreme Court practice and should have extensive experience practicing in the Ninth Circuit Court of Appeals, including litigating motions for rehearing en banc.
They should also have experience representing clients in the California courts of appeals and be familiar with the process for seeking review before the California Supreme Court. The SDAG may also advise public officials and representatives of other sections on issues that could impact the Section's work and may draft and analyze legislation and regulations.
The SDAG maintains a professional and positive relationship with colleagues, section members, support staff, clients, and courts. The SDAG must also handle administrative, personnel, and management matters, exercise appropriate discretion in handling sensitive or privileged matters, and ensure their team members are appropriately and effectively litigating their assigned appeals and producing high-quality work in an efficient manner. The SDAG's responsibilities will occasionally require work outside normal business hours.
The Correctional Law Section defends interesting and complex cases on behalf of the State in federal and state courts, including civil-rights cases, complex class actions, and related appellate work. The Section's cases involve issues ranging from state to torts to multifaceted constitutional claims, including free speech and religious rights, the provision of medical care, and the use of force. Many of the section's clients work in the state correctional system and some high-level state officials.
The appellate SDAG may be required to enter prisons for inspection or for meetings with clients and inmates. The section occasionally works on issues related to death-penalty litigation.
This is a hybrid position with the opportunity to work remotely or in the office on most days, but some regular required in-office attendance. Travel and additional in-person attendance may be required for court appearances, meetings, and other occasional operational needs.
