The Trial Division of the Oregon Department of Justice is seeking a permanent, full‑time Assistant Attorney General for its Corrections Litigation Unit (CLU). The CLU focuses on defending the Oregon Department of Corrections (ODOC) and its officers in civil lawsuits filed by current and former adults in custody. CLU attorneys independently manage high‑volume, fast‑paced caseloads in Oregon state and federal trial courts, handling state habeas, civil torts, mandamus, and federal 42 U.S.C. 1983 and constitutional claims.
The role requires research, writing, and frequent courtroom appearances and offers opportunities for both novel constitutional work and regular trial experience.
- Independently manage high‑volume, fast‑paced civil and criminal case work in state and federal courts.
- Handle state habeas, civil torts, mandamus, and federal 42 U.S.C. 1983 actions, including constitutional and civil rights claims.
- Research and draft motions to dismiss, summary judgment, and other pleadings; argue motions before state and federal courts.
- Appear in court for trials, depositions, and other proceedings, representing the state and its agencies.
- Maintain excellent client communication and a professional, collegial demeanor.
- Travel throughout Oregon for court appearances and related duties as needed.
- Collaborate with the Trial Division and other DOJ partners on complex constitutional matters.
- At least two years litigating civil actions in state or federal court as an attorney.
- Active interest in litigation and willingness to take cases to trial while seeking appropriate settlements.
- Experience writing and arguing motions to dismiss or for summary judgment.
- Ability to balance frequent court appearances with an active motions practice and maintain client communication.
- High professionalism and collegiality, and a desire to work with dedicated state clients.
- Availability to travel Oregon‑wide for trial and court obligations.
- Active membership in good standing with the Oregon State Bar or reciprocity in progress at time of application.
- Strong research and writing skills.
- Experience litigating civil rights claims.
- Civil trial experience.
- Experience taking and defending depositions in state or federal court actions.
