Overview
Supervise and complete the negotiation, drafting and administration of contracts for the purchase, sale and lease of real property. Analyze due diligence materials to identify and resolve title, survey, environmental, zoning and design issues to determine feasibility of real property purchases and leases for new store growth locations.
Responsibilities- Prepare legal documents for the acquisition of real property interests and construction of improvements, including contracts, easements, development agreements and indemnification agreements.
- Supervise completion of contract/lease contingencies and conditions during contingency period of purchase contracts and leases. Identify, analyze and resolve title, survey, environmental, zoning and design issues to determine feasibility of real property purchases and leases.
- Coordinate closing of real estate purchase and sale contracts and finalizing leases.
- Negotiate with outside parties for the acquisition of real property, including purchase contracts, leases and amendments thereto.
- Assure compliance with laws and regulations affecting real property purchase and development activities, including environmental compliance.
- Research laws affecting real property interests and provide advice and counseling to the officers and senior management of the company.
- Collaborate with Site Acquisitions team in drafting and editing acceptable Letters of Intent for contracts for the lease or purchase of real property.
- Work with Contract Negotiations group on issues and drafting of acceptable real estate purchase contracts.
- Work with Lease Negotiations group on the drafting and negotiation of leases.
- Work with Property Management team to resolve landlord-tenant disputes, lease administration issues, and managing litigation.
- Provide such additional and further professional services to promote the best interests of the Company and as assigned by the General Counsel, or Associate General Counsel/Senior Director of Legal Services.
Required:
- Juris doctorate from an accredited law school.
- Current license to practice law in at least one state.
- 5+ years legal experience in private practice or as in-house counsel
- 3+ years transactional real estate experience, including commercial leasing and land/building acquisitions.
- Excellent analytical and drafting skills.
- Strong negotiating and problem-solving skills.
- Excellent communication and interpersonal skills.
- Experience dealing with and managing outside vendors and attorneys.
- Ability and desire to work independently and cross-functionally.
- Ability to manage tight deadlines and excel in a fast-paced, high volume environment.
Desired:
- Experience in environmental law, construction law, land use and zoning, resolution of commercial property management issues and real estate litigation.
