Description:

We are seeking an experienced Canadian Trademark Agent (Of Counsel) for a remote/hybrid role in the Greater Toronto Area, Canada. This position involves advising clients on trademark strategies, conducting clearance searches, preparing and filing trademark applications, prosecution work, managing trademark portfolios, and registration renewals. Responsibilities also include handling responses to office actions, opposition, licensing, enforcement, and anti-counterfeiting initiatives, while providing guidance on overall brand protection strategies.

The successful candidate will collaborate directly with clients and team members to ensure top-tier legal service.

The Trademark Agent (Of Counsel) will act as the firm’s designated trademark agent of record before the Canadian Intellectual Property Office (CIPO), the College of Patent Agents and Trademark Agents (CPATA), and related international authorities. This role requires a deep understanding of Canadian trademark law, strong client management skills, and experience with trademark prosecution and enforcement strategies.

This is an independent counsel role (Of Counsel / Contract / Part-Time role) with responsibility for managing trademark matters and supporting business development in the IP space.

Key Responsibilities:
  • Act as the firm’s registered trademark agent of record with CPATA and CIPO.
  • Prepare, file, and prosecute Canadian trademark applications and related proceedings.
  • Conduct clearance searches and provide legal opinions on registrability and risk.
  • Advise on trademark enforcement, oppositions, cancellations, and strategy.
  • Support international trademark filings, including Madrid Protocol work and coordination with foreign counsel.
  • Draft, review, and negotiate trademark-related agreements (licenses, assignments, coexistence).
  • Provide strategic advice on brand protection, domain name interactions, and IP portfolio management.
  • Mentor and collaborate with firm lawyers on trademark risk and strategy.
Required Qualifications:
  • In-depth knowledge of trademark law, including trademark strategy, registrations, prosecution, enforcement, and licensing.
  • Experience with trademark-related research, clearance searches, and intellectual property management.
  • Skilled in contract negotiation, drafting agreements, and managing brand protection initiatives.
  • Strong analytical, organizational, and multitasking skills with attention to detail.
  • Exceptional written and verbal communication skills, with client-focused service expertise.
  • Strong knowledge of the Trademarks Act and Regulations.
  • Registered Canadian Trademark Agent in good standing with CPATA.
  • Minimum of 5+ years of Canadian trademark practice experience.
Preferred Qualifications:
  • Familiarity with international trademark laws and systems (Madrid, EUIPO, USPTO) would be an asset.
  • A proactive, business‑minded approach to legal problem‑solving.
  • Prior work with domestic or global brand owners.
