Job Duties

The OLC Long-Term Care Hearing Officer serves as a neutral and impartial

administrative hearing officer responsible for overseeing cases in which facilities

contest state or federal regulatory citations and survey deficiencies. In this role, the

Long-Term Care Hearing Officer ensures due process by conducting thorough

reviews and analyses of the administrative record, including clinical documentation,

investigative summaries, survey findings, facility statements, and testimony from

residents, families, or legal representatives when provided. Hearings are conducted

in a structured yet less formal setting than a court of law, promoting transparency

while preserving regulatory integrity and resident safety standards. After each

proceeding, the OLC Long-Term Care Hearing Officer issues timely written findings

and determinations that include a clear recommendation and/or decision for agency

action-whether to uphold, modify, or dismiss a citation-supported by concise,

well-reasoned justification aligned with applicable regulations and evidentiary

standards.

Overall this position promotes consistent regulatory application, supports nursing

home resident health and safety and contributes to effective long-term care

oversight in the Commonwealth The Virginia Department of Health offers 12 paid holidays, medical, dental, vision and life insurance, retirement plans (including 401a Cash Match and 457 Deferred Compensation Plan) as well as sick, family/personal, and annual leave.

Minimum Qualifications

* Knowledge of Long-Term Care laws, regulations, and licensing requirements, with experience evaluating compliance, weighing material facts, and applying regulatory standards in a fair and consistent manner.

* Knowledge of Medicare and Medicaid program requirements applicable to Long-Term Care providers, including conditions of participation and certification standards.

* Knowledge of Long-Term Care standards of practice, health care management, and Life Safety Code requirements, with the ability to apply these standards to compliance reviews and deficiency determinations.

* Knowledge of the Virginia Administrative Process Act (VAPA) and relevant provisions of Title 32.1 of the Code of Virginia related to licensure, enforcement, and appeals.

* Ability to review and analyze complex administrative and regulatory records, including transcripts, exhibits, and supporting documentation, and synthesize findings into clear, defensible conclusions.

* Ability to evaluate regulatory compliance and make recommendations regarding cited deficiencies at Long-Term Care facilities, including scope and severity determinations.

* Ability to assess and reconcile differing interpretations of facts and law, as presented by providers, legal counsel, survey staff, and agency personnel.

* Ability to analyze legal arguments and written submissions and determine appropriate application of Long-Term Care laws and regulations.

* Ability to conduct and participate in administrative proceedings (e.g., Informal Fact-Fnding Conferences, Informal Dispute Resolutions, and Independent Informal Dispute Resolutions) with professionalism and sound judgment.

* Strong interpersonal, written, and verbal communication skills, with the ability to work effectively with diverse stakeholders in a highly regulated environment.

Additional Considerations

* Degree in Law strongly preferred, degree in Health Care Administration, Public Administration, Health Planning, Business Administration or a related field also preferrable
