IntroductionThis position is in the District of Columbia Health Benefit Exchange Authority (DCHBX). The mission of the Health Benefit Exchange Authority is to implement a health care exchange program in the District of Columbia in accordance with the Patient Protection and Affordable Care Act (PPACA) of 2010 and the District of Columbia Health Benefit Exchange Authority Establishment Act of 2011, thereby ensuring access to quality and affordable health care to all District of Columbia residents.
The incumbent, as part of the Legal Services Division of HBX, is responsible for providing legal consultation to the HBX Board of Directors, Senior Management team, and staff covering a wide range of practice areas as required by HBX operations. The incumbent specifically oversees the agency's privacy and security processes, including but not limited to maintaining the privacy and security program and monitoring for changes in legal requirements and agency needs to ensure compliance with all District and federal laws.
The incumbent also advises agency leadership and staff on laws governing the adoption and use of AI tools and advises the agency on the implementation of Artificial Intelligence (AI) tools.
Serves as a key advisor to the Agency General Council, Deputy General Counsel, and the Executive Director in policy decision-making on privacy and security, AI, and other areas of law and policy as needed. In addition to serving as a confidant and troubleshooter, the incumbent works closely with the HBX General Counsel, Deputy General Counsel, the Executive Director, and HBX staff in the planning, coordination, and management of the legal consultation provided to the HBX.
Serves as the lead agency counsel on privacy and security to ensure compliance with District and federal law. Responsibilities include developing and maintaining HBX privacy policies and procedures, monitoring for changes in privacy and security laws and standards, overseeing and managing privacy incident protocols, including managing privacy reporting to federal and District agencies, as applicable. Developing, updating, and delivering agency privacy and security training.
Serves as agency staff lead for the agency AI governance committee, which includes supporting development, implementation, and maintenance of the agency's AI governance framework, policies, procedures, standards, and controls. Provide advice on AI governance controls, risk identification and mitigation strategies, human oversight requirements, testing protocols, and other monitoring of AI tools. Oversees review of proposed AI use cases. Review for risks, including the impact of bias impacting proposed tools and uses.
Develop and oversee testing and validation activities for proposed AI tools, including creation and/or review of testing scenarios. Participate in testing, validation, and monitoring of AI tools. Develop and maintain training on AI tools and their permissible uses within the agency. Monitor for changes in federal and District laws, regulations, and guidance, as well as changes in industry standards. Performs research and preparation of responses for the Agency General Counsel, Deputy General Counsel, Executive Director, and other members of the agency's senior management team to selected and sensitive, and often confidential inquiries and correspondence from members of Congress, the Mayor, members of the Council of the District of Columbia, officials of the District and Federal governments, the media,…
